ACUPUNCTURE EXAMINING BOARD
PUBLIC SESSION MINUTES JANUARY 21, 2009 I ROLL CALL PRESENT Henry McCann, Roger Rossi, Barbara Montana, Edith Lee, Nita Raval, Shoshanna Katzman ABSENT Mimi Vassilev-Baker, Karen Wei-Ru Lin, Mark Matzen ALSO PRESENT Megan Cordoma, DAG Renee P. Clark, Executive Director Tanya Gollett, Staff CALL TO ORDER The regular monthly meeting of the Acupuncture Examining Board was called to order at 124 Halsey Street at 9:30 a.m., all members having been notified of the time, date and, place and materials pertinent hereto having been provided. SUNSHINE LAW In compliance with Chapter 231 the Public Law of 1975, notice of this was sent to the Courier-Post and the Record. II. MINUTES A motion was made by Roger Rossi and seconded by Barbara Montana to accept the October 29, 2008 Public Session Minutes. The motion carried by unanimous vote. III. CURRICULUM REVIEW Motion was made to send California Coast University and Lynne Martin a letter stating that we recognize that this is a long distance learning program. However California Coast University does not currently have regionally accredited course for acupuncture and therefore does not meet the statutory requirements for our certification. Motion was made by Roger Rossi and seconded by Barbara Montana. Motion carried by unanimous vote. IV. CORRESPONDENCE INTERNATIONAL COLLEGE OF ACUPUNCTURE AND ELECTRO-THERAPEUTICS (ICAET) Chair directs Administrative office to send a letter to the International College of Acupuncture and Electro-therapeutics stating that they must provide specific information on clinical hours including clarifying the content, structure and format of the clinical hours. Upon motion made by Edith Lee and seconded by Roger Rossi it was moved that persons who have already graduated from ICAET or are currently enrolled in the program meet the Boards qualifications for acupuncture certification pending final decision by the Board whether ICAET continues to meet Board requirements for physician acupuncture training program. HEARING ON THE APPLICATION OF THE ATTORNEY GENERAL FOR THE TEMPORARY SUSPENSION OF THE CERTIFICATE OF YOUNG K LEE The Attorney General and counsel for Mr. Lee (Santo Bonano, Esq.) presented documentary evidence and witness testimony regarding the Attorney General’s allegations that inappropriate sexual contact with patient A.M. represents an abuse of the privilege of certification and a violation of the public trust such that there is no adequate resolution other than the suspension of Mr. Lee’s certification. Mr. Lee denied the conduct and testified on his own behalf. After deliberation in closed session, the Board determined that the Attorney General palpably demonstrated that Young K. Lee’s continued unrestricted practice of acupuncture constitutes a clear and imminent danger to the public and ordered that Mr. Lee have a Board-approved chaperone (a licensed acupuncturist) present when he sees any female patients. Additionally, Mr. Lee was ordered to undergo a psychosexual evaluation. The evaluation is to be submitted to the Board within 30 days, and the Board reserves the right to take further discipline against Mr. Lee’s certification depending on the psycho-sexual evaluation. The motion was made by Nita Raval and seconded by Barbara Montana. The motion carried by unanimous vote. Roger Rossi made a motion to refer the matter regarding Mr. Lee to the Office of Administrative Law. The motion was seconded by Barbara Montana and carried by unanimous vote.
