Regulations implementing N.J.S.A. 45:16A-1 et seq., the "State Heating, Ventilating, Air Conditioning, and Refrigeration Contracting License Law" (Act) were published on April 15, 2013 at 45 N.J.R. 910(a). The operative date for these regulations was established as October 15, 2011, later extended to January 1, 2014, in order to allow time to develop a licensing examination
On January 1, 2014, the State Board of Examiner of Heating, Ventilating, Air Conditioning, and Refrigeration Contractors (Board) will begin accepting applications for licensure. The regulations prescribe the application procedure.
The law includes a provision, N.J.S.A. 45:16A-26, that authorizes the Board to issue a Master HVACR license based on experience without examination for six months. This six-month "grandfathering" period, during which individuals currently practicing as HVACR contractors may submit an application for licensure without meeting education or examination requirements, begins on January 1, 2014 and ends on July 1, 2014.
An individual who does not submit a grandfathering application by July 1, 2014, or who does not qualify for grandfathering, will be required to apply through the regular licensing process. Such applicants must show that they completed the requisite education and must pass the Board's licensing examination.
