Alcoholic Beverage Prohibition

Proposed: July 5, 2011 at 43 N.J.R. 1505(a).
Adopted: November 9, 2011 by the Legalized Games of Chance Control Commission, Marilou Halvorsen, Chairperson.
 
Filed: March 7, 2012 as R.2012 d.070, without change.
Authority: N.J.S.A. 5:8-6.
 
Effective Date: April 2, 2012.
Expiration Date: December 21, 2014.

Summary of Public Comment and Agency Response:

The official comment period ended September 3, 2011. The Commission received no comments.

Federal Standards Statement

A Federal standards analysis is not required because the adopted amendment is governed by N.J.S.A. 5:8-6 and is not subject to any Federal requirements or standards.

Full text of the adoption follows:

13:47-7.3 Alcoholic beverage prohibition

(a) Except as provided in (b) below, no game may be conducted in any room or outdoor area where alcoholic beverages are sold, dispensed or consumed during the period between the commencement of the first and the conclusion of the last bingo game of the occasion.

(b) Alcoholic beverages may be sold or served during bingo games held on the licensed premises of the holder of a ple-nary retail consumption license pursuant to P.L. 1954, c. 6 (N.J.S.A. 33:1-12) as long as the holder of the plenary retail consumption license is licensed as an approved rentor pursuant to N.J.S.A. 5:8-49.3 and N.J.A.C. 13:47-14.2.
