Entertainment Agency Licenses; Posting

Take notice that the Division of Consumer Affairs discovered an error in N.J.A.C. 13:45B-6.4(c). As N.J.A.C. 13:45B was originally promulgated, "Bureau" referred to the Division's Bureau of Employment and Personnel Services (see N.J.A.C. 13:45B-1.2, as effective September 21, 1992 ; 24 N.J.R. 3316(a)). Pursuant to Reorganization Plan No. 002-1992 , the Bureau of Employment and Personnel Services and the Charities Registration Section were transferred to the Division's Office of Consumer Protection, where they constitute the Regulated Business Section. Effective November 7, 1994 , the Division promulgated amendments to N.J.A.C. 13:45B that included replacement throughout of "Bureau" with the defined word "Section." See 26 N.J.R. 4316(a); 27 N.J.R. 1430(a). Overlooked in those amendments was the use of "Bureau" in subsection (c) of N.J.A.C. 13:45B-6.3 (since recodified as N.J.A.C. 13:45B-6.4). Through this notice of administrative correction, published pursuant to N.J.A.C. 1:30-2.7, "Bureau" is replaced with "Section" in N.J.A.C. 13:45B-6.4(c).

Full text of the corrected rule follows (addition indicated in boldface thus; deletion indicated in brackets [thus]):

13:45B-6.4 Entertainment agency licenses; posting

(a)-(b) (No change.)

(c) There shall be posted in each entertainment agency the agency's schedule of fees, as well as a certified abstract of the Act and this chapter. Such posting shall be in a manner and place as to be readily visible and legible by persons doing business with the agency. The entertainment agency also shall have full copies of the Act and this chapter available for review by any job seeker or employer. The certified abstract shall be available from the [Bureau] Section for a fee of $ 5.00.
