ALCOHOL AND DRUG COUNSELOR COMMITTEE
PUBLIC SESSION MINUTES May 15, 2009 I. CALL TO ORDER This scheduled meeting was called to order at 9:43 a.m., in the Somerset Conference Room, 6th floor, 124 Halsey Street, Newark, New Jersey. II. ROLL CALL Present:
Committee Chairman, Edward Reading Recused: Committee Member, Lorenzo Puertas Until the matter is resolved, Public Member, Lorenzo Puertas recused from attendance based on services he provides related to the profession that may be a possible violation of the statutory requirement for public board members. Announcement of quorum was made by Committee Chair, Dr. Reading.
Administrative Staff: Elaine L. DeMars III. APPROVAL OF MINUTES On a motion made by Jamie Lugo, seconded by Norwood Allen, the minutes of the April 24, 2009 public session meeting were approved as presented. IV. PUBLIC COMMENT In attendance:

Notice of Rule Proposal: N.J.A.C. 13:34C-1 et seq. VI. OLD BUSINESS Substance Abuse Evaluator; Title and Function A. Rhonda S. Berliner-Gold, Esq., Labor and Employee Relations Unit, Administrative Office of the Courts Carol Venditto, Manager, Drug Court Manager, Administrative Office of the Courts Jayne Cavanaugh, TASC Coordinator, Administrative Office of the Courts Daniel Zeith, Esq. Fox and Fox, LLP for PANJ Rhonda Berliner-Gold, Esq., Carol Venditto and Jayne Cavanaugh addressed the Committee regarding Ms. Berliner- Gold’s letter dated March 25, 2009. They described the role, functions and supervision of individuals working in the Substance Abuse Evaluator (SAE) title in the courts. The Committee also reviewed the letters dated December 15, 2008 and March 12, 2009 as well as information provided by Lynsey Johnson, Esq., Fox and Fox, LLP for PANJ and related parties during the February 26, 2009 public agenda meeting. Based on the information that the Committee reviewed it appears that the functions performed by the individuals in the Substance Abuse Evaluator title are consistent with the 12-core functions set forth in N.J.A.C. 13:34C-3.1 (b)1 and (c)1. VII. FILED CONSENT ORDERS A. Philip H. Harrison May 4, 2009 Filed Consent Order: Suspension of license for five years for engaging in professional misconduct. B. Laura N. Harrison - May 15, 2009 Filed Consent Order: Suspension of license for five years for engaging in professional misconduct. C. Allen Bradley May 15, 2009 Filed Consent Order: Cease and Desist the unlicensed practice of alcohol and drug counseling. VIII. NEXT MEETING
The next meeting of the Committee is scheduled for June 19, 2009 at 9:30 a.m. at
June 19, 2009 October 23, 2009 IX. EXECUTIVE SESSION The Committee will move to Executive Session to conduct investigative inquiries, review criminal history background reports, pending disciplinary and confidential matters. X. REVIEW OF CREDENTIALS Applications for licensure and certification will be reviewed and moved for approval.
