NEW JERSEY STATE BOARD OF ARCHITECTS I CALL TO ORDER The regularly scheduled meeting of the Board was called to order at 9:20 am in the Union Conference Room on the third (3rd) floor at 124 Halsey Street, Newark, New Jersey
OTHERS PRESENT: B. Michelle Albertson, Deputy Attorney General; James S. Hsu, Executive Director, Board of Architects; Margaret Hinkley, Secretary to Executive Director; Joseph Abello of the Board of Architects. II OPEN PUBLIC MEETINGS ACT The statement required by Chapter 231, public laws of 1975, the "Open Public Meetings Act," was read and it was announced that notice of this meeting was prepared in the office of the Board of Architects and mailed to the Secretary of State, the Newark Star-Ledger, the Trenton Times, the Camden Courier-Post, the Record and the Atlantic City Press. III APPROVAL OF MINUTES April 10, 2008 Editorial change was made to page 2 at the top. ACTION: Mr. Horii motioned to approve the minutes as amended. Mr. DeMassi seconded the motion. It was unanimously approved. IV ANNOUNCEMENTS Executive Director Hsu announced that the investigative inquiries scheduled for today pertaining to ITEM Nos. 54927 & 57388 have been postponed and re-scheduled for a future meeting. Mr. Zaccone reminded members that the NCARB Annual meeting is in June and that the Board will review the resolutions, scheduled for voting at the NCARB meeting, at a May meeting. Due to a backlog in inquiries, it was suggested that a letter be sent to the Governor’s office requesting that he appoint new members to the Board of Architects. There are four vacancies on the Board, due to the resignations of the Government Member in June, 2002; a Public Member in September 2006; an Architect Member in September 2007; Public Member in March 2008. With these vacancies, the Board requests that new appointments be made to the Board of Architects as soon as possible. V OLD BUSINESS A-2146 which revises the regulation of Landscape Architects DAG Albertson informed the Board that legislation to revise the regulation of landscape architects under bill A-2146 has been introduced in the Assembly, referred to Committee and then voted out of Committee with changes. Many of the Board's comments appear to have been incorporated into the bill. However, there are two changes in the bill that concern the Board, namely, the exemption language approved by the Board for Architects and Professional Engineers was not included, and, further, the requirements for architects and engineers to become licensed Landscape Architects appears to be more stringent (5+ years of experience plus review of education) than for an initial applicant for licensure. On February 28th, Mr. DeMassi motioned that the Board opposes bill A-2146 in its current format. Ms. Schlegel seconded the motion. It passed unanimously. The Board however, supports the licensing of landscape architects. On March 13, 2008, Burt Liebman, Legislative Liaison and Patricia Schiripo, Regulatory Analyst both from the Division of Consumer Affairs met with the Board to discuss their concerns with the legislation and the language that was not incorporated into the bill. AIA Liaison representative Michael Soriano concurred with the Board’s concerns of the language not included in the bill. Grandfather clause language was discussed as well as other language that would allow architects to continue practicing landscape architecture under their architect license. 4/24/08 Status of legislation ACTION: Mr. DeMassi motioned to have request from Burt Leibman, Legislation Liaison, Division of Consumer Affairs, a copy of the written response outlining the Board’s comment to this legislation which was forwarded to the Attorney General’s office. Mr. Joshi seconded the motion. It passed unanimously. VI NEW BUSINESS A Information Copy of an April 11th e-mail from NCARB regarding ARE News is attached for the Board’s information. ACTION: Duly noted. B Correspondence Copy of a March 5, 2008 letter from Barrett D. Kolton of Mobility Consulting Group, LLC, requesting a written opinion that he does not need a license for his consulting business is attached for the Board’s information. ACTION: Subsequent to reviewing this letter, Mr. DeMassi motioned to send a letter requesting more detailed description and process of his involvement; submit a list of all New Jersey projects and include the name/s of the architects for each project. Mr. Joshi seconded the motion. It passed unanimously. C Landscape Architect Examination and Evaluation Committee March 19, 2008 minutes ACTION: Mr. DeMassi motioned to approve the Landscape Architect Committee minutes with the exception of the Committee’s comment of three (3) landscape architects be added to the Board which is inconsistent to the Board of Architect’s position to Bill A2146. Mr. Joshi seconded the motion. Mr. Kniesler abstained. Motion passed. VII REVIEW OF APPLICATIONS VIII PUBLIC COMMENTS Seeing no one present from the public, Mr. Zaccone proceeded to the next item on the agenda. IX CLOSED CASES 1 ITEM NO. 47843 - VIDRAK, Leonid - AI013742 ACTION: Upon reviewing the signed consent order received from Mr. Vidrak, Mr. DeMassi motioned to accept the consent order and close out this matter. Mr. Horii seconded the motion. It was unanimously approved. CASE CLOSED 2 ITEM NO. 52820 - DZEMA, Douglas - Unlicensed / NALLE, William - Unlicensed ACTION: Upon reviewing the signed cease and desist letter from Messrs. Dzema and Nalle. Mr. DeMassi motioned to accept the consent order and close out this matter. Mr. Horii seconded the motion. It was unanimously approved. CASE CLOSED X EXECUTIVE SESSION At 10:25am, Mr. DeMassi motioned to go into executive session for the purposes of reviewing the minutes and disciplinary matters on the agenda.
