Attached for the Board?s consideration is the Attorney General?s Motion for Interlocutory review of ALJ Bruce Gorman?s recent decision to permit the Respondent to take the depositions of two of the Attorney General?s witnesses. Respondent?s response is also attached.

By way of a Provision Order of Discipline (the "POD") entered on or about March 24, 2008, the Attorney General sought to reprimand Dr. Agarwala for professional misconduct. Dr. Agarwala filed a response to the POD on or about May 23, 2008. The Attorney General recommends that the POD be finalized with the modifications noted herein.

By way of a Provision Order of Discipline (the "POD") entered on or about May 28, 2008, the Attorney General sought to suspend Dr. Kirkorov?s license to practice medicine and surgery in the State of New Jersey until such time as his New York license is reinstated without restrictions or conditions. Dr. Kirkorov filed a response to the POD on or about June 3, 2008. The Attorney General recommends that the POD be finalized without the modifications requested.
