A Verified Complaint in the above referenced matter was filed by the Attorney General on July 28, 2009 by the New Jersey State Board of Medical Examiners (the “Board”). The time within which Respondent was to file an Answer has long since expired and has not been extended or enlarged. The Attorney General subsequently filed, on or about September 19, 2009, a Notice of Motion for Default and for Default Judgment (the “Default Motion”). In the Default Motion, the Attorney General seeks, inter alia, a default judgment including but not limited to the permanent suspension of Dr. Fernando’s license to practice medicine and surgery in the State of New Jersey. The Board records show that a copy of the Default Motion was sent to Dr. Fernando’s last known address of record maintained by the Board. No response by Dr. Fernando to the Verified Complaint or the Default Motion has been received by the Board office. In light of Dr. Fernando’s failure to respond, as indicated in the Notice of Motion, this matter is scheduled to be heard on the papers
