CONSENT ORDER OF PROBATION filed July 11, 2008. This matter was opened to the Board upon receipt of information revealing Dr. Clemments’ license to practice medicine in New York was placed on probation by Order filed on October 24, 2007. The New York action was based upon his delegation of professional responsibilities requiring licensure to persons he had reason to know were not licensed social workers. Based upon the findings and it appearing Dr. Clemments wished to resolve this matter without formal proceedings and having waived any right to a hearing, the Board ordered and Dr. Clemments agreed to, his license to practice medicine and surgery in New Jersey be placed on probation for three years, during which time he will not hold any ownership interest in, nor serve as an officer, manager or medical director of any medical practice or facility. EFFECTIVE DATE: July 11, 2008.

CONSENT ORDER filed July 10, 2008. This matter was opened to the Board upon receipt of information that on or about April 26, 2007, the New York Board entered into a Consent Agreement and Order with Dr. Deol charging him with seven instances of professional misconduct as specified in the Statement of Charges. Dr. Deol did not contest the first Specification charging him with negligence on more than one occasion concerning factual allegations of treatment of B.1 and B.3 in full satisfaction of the charges against him. Dr. Deol agreed to have his license in New York suspended for three years, but the suspension is stayed as long as he complies with the terms of probation, undergo a clinical competency assessment within 60 days of entry of the Order, maintain an active registration with the New York State Education Department and engage a practice monitor to be approved by the New York Board within thirty days of the effective date of the Order. The above disciplinary action taken by the sister state of New York provided grounds to take disciplinary action against Dr. Deol’s license to practice medicine and surgery in New Jersey, in that, he had his authority to engage in the activity regulated by the Board suspended by another State for reasons which would be cause for discipline in New Jersey. The Board ordered and Dr. Deol agreed to a formal reprimand be placed on his license in New Jersey for professional misconduct. Dr. Deol will not engage in the practice of medicine and surgery in New Jersey until such time as he can demonstrate he has an active, unrestricted license in New York. Additionally, prior to him engaging in the active practice in New Jersey, he will appear before the Board, or a Committee thereof, to demonstrate that he has completely satisfied the conditions placed on his license to practice medicine in New York and that his New York license is active and unrestricted and that he is fit to practice medicine and surgery in New Jersey. EFFECTIVE DATE: July 10, 2008.

FINAL ORDER filed July 17, 2008. This matter was opened to the Board upon the filing of an Administrative Complaint and Notice of Hearing. Dr. Faswala’s license was temporarily suspended by order filed April 11, 2005. Dr. Faswala never filed a response to the Complaint and a Notice of Motion for Default was filed on May 23, 2007. Dr. Faswala did not appear at the Board’s hearing on July 11, 2007, and evidence was presented to the Board that reasonable efforts had been made to serve Dr. Faswala with notice of the Complaint as well as the Motion for Default. The Board found adequate service had been effectuated of both the Verified Complaint and the Notice of Motion for Default and therefore, found Dr. Faswala in default. The Complaint alleged Dr. Faswala prescribed and dispensed controlled substances indiscriminately to an undercover officer on three occasions and without good cause. It was further alleged Dr. Faswala prescribed Xanax, Fioricet, Zydone, Calcifol and Soma without examination or touching of his patients; he did not take the patients histories; and simply in exchange for a $100 payment and a request for “pills.” Given the findings, the Board granted the Motion for Default. The Board found Dr. Faswala’s conduct constituted dishonesty, gross and repeated malpractice, professional misconduct, incapability of discharging the functions of a licensee consistent with public safety and health, indiscriminate prescribing or prescribing without good cause, and conduct contrary to the regulations governing the dispensing and prescribing of controlled dangerous substances. The Board ordered the license of Dr. Faswala to practice medicine and surgery in New Jersey revoked immediately. Dr. Faswala is to pay a penalty in the amount of $50,000.00 and costs in the amount of $10, 526.26 within 30 days of the date of this order. This action may be subject to reopening, if Dr. Faswala can demonstrate that he did not receive notice of the Complaint and/or default proceeding. EFFECTIVE DATE: July 8, 2008.

ORDER OF SURRENDER WITH PREJUDICE, DEEMED A REVOCATION filed July 23, 2008. This matter was opened to the Board upon notice from the U.S. Drug Enforcement that drug addicted persons were obtaining CDS pain medication with little or no documentation of medical necessity. Similar complaints were lodged with the Enforcement Bureau by area pharmacists. In October 2007, investigators from the Enforcement Bureau and the DEA interviewed Dr. Feltoon concerning his continued practice of medicine and issuance of CDS prescriptions after his registrations expired. On January 23, 2008, Dr. Feltoon appeared with counsel before a Committee of the Board and testified regarding his expired license and expired DEA registration, his failure to carry medical malpractice insurance, as well as his care, treatment and prescribing practices in his family/general medicine practice. The Board having reviewed the entire record, including the testimony of Dr. Feltoon at an investigative inquiry, various patient records, and the Report of Investigation, concluded that the facts before them established a basis for disciplinary action. Dr. Feltoon being desirous to resolve this matter without recourse to further proceedings, and the Board finding the within resolution to be in the public interest and for good cause shown, ordered and Dr. Feltoon agreed to relinquish his license to practice medicine and surgery, said surrender to be deemed a revocation with prejudice to any re-application for licensure. Dr. Feltoon is to immediately cease and desist from the practice of medicine and surgery. He is to pay a penalty in the amount of $10,000.00 and costs in the amount of $21,932.00, however, Dr. Feltoon’s obligation to pay the penalty and costs will be stayed so long as he complies with the terms of this Order. In the event he violates a material term of this Order, penalty and costs will become immediately due. EFFECTIVE DATE: July 23, 2008.

CONSENT ORDER filed July 24, 2008. This matter was opened to the Board upon the filing of an Order to Show Cause and Verified Complaint on May 14, 2008, seeking the temporary suspension of Dr. Ferstandig's license to practice medicine. The Verified Complaint alleged Dr. Ferstandig admitted usage of cocaine in addition to other conduct demonstrating he is incapable of discharging the functions of a licensee in a manner consistent with the public’s health, safety and welfare. The Board’s file reflects Dr. Ferstandig has a history of substance abuse, as well as a previous suspension from practice by the Board. Dr. Ferstandig’s, through counsel, entered a general denial of the charges and consented to the voluntary surrender of his license pursuant to an Interim Order of Voluntary Surrender, effective on the close of business May 23, 2008. Dr. Ferstandig was to undergo an evaluation under the auspicious of the Professional Assistance Program (“PAP”), and to provide the results to the Board and the Attorney General. The Board noted that Dr. Ferstandig voluntarily cooperated in a thorough investigation and the evaluation done by the PAP. Upon review of the materials submitted to the Attorney General and the Board from the PAP, the Board determined that this Order is adequately protective of the public and is entered in full resolution of the Verified Complaint filed on May 14, 2008. The Board ordered the license of Dr. Ferstandig restored to him effective July 9, 2008. Dr. Ferstandig is hereby reprimanded for professional misconduct. He is to comply with all terms imposed by the PAP and the psychiatric recommendations set forth in his evaluation dated June 30, 2008; is to have absolute abstinence from all psychoactive substances, including alcohol; is to attend documented attendance at AA a minimum of three meetings per week; is to have random urine drug screens a minimum of two to three times per week; is to engage with a therapist to address his identified mood disorder; is to be seen in follow up by a clinical representative of the PAP on a monthly basis for the first twelve months of his re-licensure; is not to practice psychiatry as a solo practitioner and prior to resuming employment, he must propose to the PAP and to the Board the circumstances under which he intends to resume practice; and this Order will constitute a full and final resolution of the charges embodied in the Administrative Complaint filed May 14, 2008. EFFECTIVE DATE: July 9, 2008.

FINAL ORDER OF DISCIPLINE filed July 17, 2008. The matter was opened to the Board upon receipt of information that Dr. Galin failed to submit his biennial renewal in 1999, and his license to practice medicine was automatically suspended. A Provisional Order of Discipline was entered by the Board on November 17, 1999. Since that time, a Judgement of Conviction was entered against Dr. Galin, thus necessitating the filing of an amended Provisional Order of Discipline on September 19, 2001, which incorporated the provisions of the original Provisional Order of Discipline. The Amended Provisional Order of Discipline provided that on or about June 12, 1997, the New York board revoked Dr. Galin’s license to practice medicine and ordered him to pay $55,000.00. The New York Board found Dr. Galin had been negligent in the treatment of 11 patients; had practiced the profession fraudulently; used fraudulent billing practices; and failed to maintain adequate medical records. Among other things, the New York Board specifically found he had performed excessive tests which were not medically indicated; that he billed for surgeries and/or tests not performed; that he altered medical records to support such fraudulent billing; and that in some cases he had practiced negligently. Dr. Galin appealed the New York Order to the New York Supreme Count and the appeal was dismissed on March 4, 1999. Thereafter, Dr. Galin entered a guilty plea to Counts 1 and 2 of a Superseding Information on July 19, 2000. As a result of the criminal conviction, Dr. Galin was sentenced on October 12, 2000, to imprisonment for 37 months. The New York actions provided grounds for disciplinary action against Dr. Galin’s license to practice medicine in New Jersey, in that his acts conclusively establish that he had engaged in acts of dishonesty, fraud, deception, misrepresentation, and false pretense; that he engaged in repeated acts of negligence and professional misconduct; that he had been convicted of a crime; and that his license in New York had been revoked. The New Jersey Board ordered Dr. Galin’s license to practice medicine and surgery in New Jersey revoked. EFFECTIVE DATE: July 17, 2008.

FINAL ORDER OF DISCIPLINE filed July 25, 2008. This matter was opened to the Board upon receipt of information which the Board has reviewed. Dr. Gupta failed to submit his biennial renewal in 1999, and his license to practice medicine in New Jersey was automatically suspended. On or about May 30, 2002, in the Supreme Court of New York, Dr. Gupta pled guilty to Grand Larceny and was sentenced to five years probation and required to pay $180,000.00 in restitution. Thereafter, on or about September 4, 2002, the New York Board entered a Determination and Order based on Dr. Gupta criminal conviction and later determined that the appropriate penalty for this misconduct was revocation of his license to practice medicine in New York State. The above disciplinary action taken by the sister State of New York provided grounds for the New Jersey Board to take disciplinary action against Dr. Gupta’s license in New Jersey. The Board ordered the license of Dr. Gupta to practice medicine and surgery in New Jersey suspended until such time as his license to practice medicine is fully reinstated without restrictions in the State of New York. Prior to Dr. Gupta resuming active practice in New Jersey he will be required to appear before the New Jersey Board, or a Committee thereof, to demonstrate fitness to resume practice. EFFECTIVE DATE: nunc pro tunc March 2, 2004.

CONSENT ORDER filed July 10, 2008. This matter was opened to the Board upon review of Mr. Conway’s application for licensure as a Clinical Alcohol and Drug Counselor. The application stated Dr. Razin had supervised Mr. Conway’s practice from February 1991 until March 26, 2004. Mr. Conway practiced at NVA, not licensed or certified to practice alcohol and drug counseling in New Jersey and was not licensed or certified to perform any mental health counseling. Dr. Razin appeared before the Alcohol and Drug Counselor Committee on September 21, 2007, and testified that from 2000 until April 2007, he was the supervising psychiatrist for NVA. The Board found Dr. Razin aided and abetted the unlicensed practice of medicine, and alcohol and drug counseling. The Board ordered and Dr. Razin agreed to cease and desist from aiding and abetting the unlicensed practice of medicine, and alcohol and drug counseling. Dr. Razin is reprimanded for aiding and abetting the unlicensed practice of medicine, and alcohol and drug counseling; h. He also is to cease and desist from engaging in clinical supervision of alcohol and drug counseling interns, and certified alcohol and drug counselors, unless and until he is approved by the Alcohol and Drug Counselor Committee of the New Jersey Board. Finally, he is to pay a penalty in the amount of $1,000.00. EFFECTIVE DATE: July 10, 2008.

INTERIM ORDER OF REINSTATEMENT OF LICENSURE WITH RESTRICTIONS filed July 7, 2008. This matter was opened to the Board upon a request from Dr. Reiter for reinstatement of his medical license. On February 22, 2002, the Board revoked Dr. Reiter’s license effective and retroactive to October 10, 2001. Dr. Reiter’s license was revoked based upon his conviction of second degree criminal sexual assault and criminal sexual contact involving several patients. On February 14, 2007, the Board denied Dr. Reiter’s request for reinstatement until such time as all evaluations outlined in that Order were accomplished. On September 26, 2007, the Board again denied him reinstatement due to the CPEP assessment dated May 2007, which identified areas of demonstrated need in both medical knowledge and judgment. On January 16, 2008, Dr. Reiter again appeared before the Board requesting that he be granted a limited license for the purpose of completing the CPEP education plan. Dr. Reiter testified that he had completed the “shadowing” phase of the CPEP education plan and had begun the “supervision” phase of the CPEP education plan without a medical license for three days. Dr. Reiter testified further that he did not believe he was required to have a medical license to begin the “supervision” phase of the CPEP education plan. Thereafter, Dr. Reiter’s counsel requested an adjournment and Dr. Reiter agreed to immediately cease and desist from continuing the “supervision” phase of the CPEP education plan. Dr. Reiter appeared on February 27, 2008, to continue his testimony and based upon his testimony and review of documentation provided to the Board, the Board ordered and Dr. Reiter agreed to practice medicine and surgery for a maximum of eighteen months, limited to and, for the sole purpose of completion of the CPEP education plan dated November 17, 2007. Dr. Reiter at all times must work under the supervision and responsibility of a preceptor or supervisor approved by CPEP and accepted by the Board; assure the supervisor submits quarterly reports to the Board; complete a post-education evaluation by CPEP; obtain a Board approved chaperone who will be present with him whenever he is in the presence of any female patient; attend and successfully complete a Board approved boundaries course; undergo face-to-face meetings with a PAP representative once every three months; and undergo psychotherapy with a Board approved licensed psychiatrist or psychologist a minimum of once a month. EFFECTIVE DATE: July 7, 2008.

CONSENT ORDER filed July 10, 2008. This matter was opened to the Board upon receipt of information that Dr. Sayed was not in compliance with the conditions and monitoring established in the Consent Order of Reinstatement filed November 13, 2007. Specifically, the Board was notified that Dr. Sayed had experienced two relapses into alcohol use. A Position Statement dated April 23, 2008 from the Professional Assistance Program (“PAP”) informed the Board that the urine specimens collected from Dr. Sayed were positive for the presence of ethylgluconoride, a confirmatory finding indicative of the presence of alcohol, which is in violation of the November 13, 2007 Consent Order. On April 23, 2008, Dr. Sayed appeared before the Board regarding his failure to comply with the November 13, 2007 Consent Order. The Board ordered and Dr. Sayed agreed to his license to practice medicine remaining limited and subject to conditions. Dr. Sayed must maintain absolute abstinence from all psychoactive substances; remain actively involved with the PAP; continue his treatment with his therapist, comply with all recommendations and ensure the Board receives quarterly reports; attend AA meetings at least three times a week; continue random weekly urine screening by the PAP; and ensure the Board receives quarterly reports from the PAP as to his performance. EFFECTIVE DATE: July 10, 2008.

On June 30, 2005, Dr. Sharma’s license lapsed, which resulted in the automatic suspension of his license to practice medicine and surgery in New Jersey. On or about June 27, 2007, the Florida Board entered a Final Order of revocation of Dr. Sharma’s medical license. The Florida Board found Dr. Sharma inappropriately prescribed controlled dangerous substances; failed to practice medicine with the level of care, skill and treatment recognized by a reasonably prudent similar physician as being acceptable under similar conditions and circumstances; failed to keep medical records that justify the course of treatment; failed to keep a record of drugs prescribed, dispensed or administered; failed to comply with a lawfully issued subpoena; and failed to perform a statutory or legal obligation placed upon a licensed physician. The disciplinary actions taken by the Florida Board provided grounds to take disciplinary action against Dr. Sharma’s license to practice medicine and surgery in New Jersey. The New Jersey Board ordered the license of Dr. Sharma to practice medicine and surgery in New Jersey revoked. EFFECTIVE DATE: July 23, 2008.

ORDER GRANTING UNRESTRICTED LICENSURE filed July 22, 2008. This matter was opened to the Board upon receipt of Dr. Speth’s application for an unrestricted license. Dr. Speth was convicted on December 5, 1997 for witness tampering. Pursuant to an Interim Consent Order dated June 10, 1998, Dr. Speth voluntarily surrendered his license to practice medicine pending the outcome of his appeal of the criminal conviction. On January 12, 2006, Dr. Speth’s license was reinstated and placed on probation for two years. Dr. Speth appeared and testified before a Committee of the Board on May 28, 2008, and the Board after considering Dr. Speth’s testimony and all relevant documentation found Dr. Speth had complied with all terms of probation in the 2006 Consent Order.
