A meeting of the New Jersey State Board of Medical Examiners was held on Wednesday,
April 9, 2008 at the Richard J. Hughes Justice Complex, 25 Market Street, 4th Floor Conference Center, Trenton, New Jersey. The meeting was called to order by Karen Criss, R.N., C.N.M., Vice President.
PRESENT
Board Members Cheema, Ciechanowski, Clemency Kohler, Criss, DeGregorio, Jordan, Lomazow, Mendelowitz, Paul, Reichman, Salas-Lopez, Scott, Walsh, Weiss and Wheeler.
EXCUSED
Board Members Criscito, Haddad, Lambert, Nussbaum, Stanley and Strand.
ALSO PRESENT
Deputy Attorneys General Ehrenkrantz, Levine and Warhaftig, Executive Director Roeder and Medical Education Director Blanks.
STATEMENT CONCERNING THE
ANNUAL NOTICE OF PUBLIC MEETINGS
The requirements of the “Open Public Meetings Act” have been satisfied by notice of this meeting given in the annual notice adopted by the New Jersey State Board of Medical Examiners on September 26, 2007 which was transmitted to the ATLANTIC CITY PRESS, STAR LEDGER, CAMDEN COURIER POST, ASBURY PARK PRESS, BERGEN RECORD and the TRENTON TIMES, all on the 1st day of October 2007.

MINUTES THE BOARD, UPON MOTION MADE AND SECONDED, VOTED TO APPROVE THE MARCH 19, 2008 OPEN BOARD MINUTES.
NEW BUSINESS
1. NJ PURE MALPRACTICE INSURANCE
NJ Pure requested that the New Jersey Board of Medical Examiners issue an official opinion regarding its requirement that policies with defense cost offset features must meet the N.J.A.C. 11:13-7.3's requirement in order to fulfill the coverage requirement promulgated by the Board. Furthermore, they urged the New Jersey Board of Medical Examiners to issue a statement to New Jersey physicians urging them to be informed of the various pitfalls of purchasing this type of RRG policy.
THE BOARD, UPON MOTION MADE AND SECONDED, VOTED TO REFER THIS MATTER TO THE RECENTLY FORMED MALPRACTICE INSURANCE REQUIREMENTS’ COMMITTEE.
It was noted that Drs. Reichman and Scott and Mr. Wheeler were appointed as members of that committee.
2. LEGISLATION
A2504 seeks to require certain ambulatory care facilities to provide services to patients without regard to ability to pay or source of payment On or about March 13, 2008, it was introduced and referred to the Assembly Financial Institutions and Insurance Committee.
THE BOARD, UPON MOTION MADE AND SECONDED, DID NOT BELIEVE THAT THIS MATTER WAS WITHIN THE PURVIEW OF THE BOARD AND DECLINED TO MAKE ANY COMMENTS.
