I CALL TO ORDER

The regular monthly meeting of the Board of Cosmetology and Hairstyling was called to order at 9:30 a.m.

The Board recited the Pledge of Allegiance and had a moment of silence for the fallen soldiers and those serving our country.

Roll Call:

Ms. Janice Alvarez, Mr. Ronald Jerome Brown, Ms. Maria Cruz Denzer, Mr. Jack A. Fornaro, Mr. James J. Forte, Mr. Peter Macri, Mr. Joseph Santagata, Mr. Jerry Speziale, Mr. Patrick J. McNally, Assistant Executive Director and Ms. Barbara Ambroise, Program Development Assistant were present.

Mr. Chris Jones and Mr. Jay A. Malanga, Executive Director were absent.

Also in Attendance:

Ms. Gracinda Almeida, Administrative Assistant, Ms. Marisol Rodrigues, Office Supervisor, Ms. Yolanda Morales, Principle Transcriber and the Board’s counsel.

II OPEN PUBLIC MEETINGS ACT

The Chair announced that the time, date and location of the meeting was listed in the Annual Notice Schedule. The Annual Notice Schedule was mailed to Ms. Nina Mitchell Wells, Secretary of State and the Newark Star-Ledger and Trentonian Newspapers on December 15, 2008 and was posted in the Office of the Board of Cosmetology and Hairstyling on December 15, 2008.

III APPROVAL OF MINUTES (OPEN & CLOSED)

Upon motion made by Mr. Peter Macri and seconded by Mr. James Forte, the Executive Director's report, Committee reports and Minutes of the regular monthly meeting held September 8, 2009 are accepted as read. The motion passed unanimously.

IV PUBLIC PARTICIPATION SESSION

Ms. Raymond Testa of the School Association was in attendance and greeted the Board.

Ms. Darlene Fox, School Association was also in attendance.

V EXECUTIVE DIRECTOR'S ANNOUNCEMENTS

VI FOR BOARD CONSIDERATION

1. Correspondence received from Ms. Maria Anton, t/a Beauty Secrets, 289 Franklin Avenue, Nutley, New Jersey in connection with the outstanding penalty assessed against her in the amount of $200.00 for the alleged violation resulting out of an inspection of her shop on May 8, 2008 was presented to the Board for consideration. She indicated that she would like to waive her right to a hearing but furnished a written explanation for the Board to consider before rendering its final decision.

After careful consideration, upon motion made by Mr. Peter Macri and seconded by Mr. Jack Fornaro, the fines stand. The motion passed unanimously.

2. Correspondence received from Ms. Rosario Pollina, t/a Sam’s Jackson Barber Shop, 2042 West County Line Road, Jackson, New Jersey 08527 in connection with the outstanding penalty assessed against her in the amount of $550.00 for the alleged violation resulting out of an inspection of her shop on March 12, 2009 was presented to the Board for consideration. She indicated that she would like to waive her right to a hearing but furnished a written explanation for the Board to consider before rendering its final decision.

After careful consideration, upon motion made by Ms. Janice Alvarez and seconded by Mr. Jack Fornaro, the fines stand. The motion passed unanimously.

3. Correspondence received from Patrick A. Cruet, Assistant Principal, Cumberland County Technical Education Center requesting Board approval to offer the Teacher of Cosmetology (Master Educator) Program was presented to the Board for consideration.

Upon motion made by Mr. Peter Macri and seconded by Mr. Jerry Speziale, this matter is to be tabled and referred to the School Committee. The motion passed unanimously.

4. Correspondence received from Mr. Norman A. Randolph, Jr., 447 Etra Road, Hightstown, New Jersey in connection with his application for initial (renewal) shop licensure of The Soul Barber Shop, 278 Academy Street, Hightstown, New Jersey was presented to the Board for consideration.

After careful consideration, upon motion made by Ms. Janice Alvarez and seconded by Mr. Peter Macri, Mr. Randolph’s request is denied and he will have to meet the minimum square footage requirements to obtain a shop license. The motion passed unanimously.

The Board also directed that Mr. Randolph be informed that he must have in excess of 350 square feet in order to have his shoe repair business as an ancillary service.

5. IMO John R. DiMeo, President, t/a Cherry Hill All Sports Barber Shop, 2431 Church Road Plaza, Cherry Hill, New Jersey recommended for administrative closure was presented to the Board for consideration.

Upon motion made by Mr. Joseph Santagata and seconded by Ms. Maria Denzer, this matter is to be administratively closed. The motion passed unanimously.

6. IMO Jason Hill, t/a Allstars Barber Shop, 45 Jones Street, Newark, New Jersey recommended for administrative closure was presented to the Board for consideration.

Upon motion made by Mr. Peter Macri and seconded by Mr. Jack Fornaro, this matter is to be administratively closed. The motion passed unanimously.

7. The following Uniform Penalty Letters (UPLs) are recommended for administrative closure due to, including but not limited to, the age of the matter, incorrect address, no forwarding address for the business or licensee, and limited information on the licensee.

Upon motion made by Mr. Joseph Santagata and seconded by Mr. James Forte, the above listed matters are to be administratively closed. The motion passed unanimously.

8. Disciplinary Matters Pending Conclusion by Default

The UPLs were issued and no written response from respondents have been received by the Board to date. These matters were subject to finalization 15 days after issuance. The Attorney General seeks to issue Final Decision and Default Order on UPL for each of the following: IMO

Upon motion made by Ms. Janice Alvarez and seconded by Mr. Jerry Speziale, the Board authorizes the issuance of Default letters as indicated above. The motion passed unanimously.

9. IMO Denise V. Oliveto application for shop licensure of Salon & Spa Gabanti, Whippany, New Jersey and her criminal offense.

Upon motion made by Mr. Peter Macri and seconded by Mr. Jack Fornaro, Ms. Oliveto’s criminal offense will not bar her from obtaining a shop license provided she have no further contact with the criminal justice system. The motion passed unanimously.

VII EXECUTIVE SESSION

Upon motion made by Mr. Peter Macri and seconded by Ms. Janice Alvarez, the Board went into Executive Session to conduct investigative inquiries. The motion passed unanimously.

Upon motion made by Mr. Jerry Speziale and seconded by Mr. Jack Fornaro, the Board returned to Open Session to announce its decision. The motion passed unanimously.

11:15 A.M. IMO Jennifer D. Dalponte

Upon motion made by Mr. Joseph Santagata and seconded by Ms. Maria Cruz Denzer, Ms. Jennifer D. Dalponte’s conviction will not bar her from licensure provided she submit a detailed report from her probation officer, thereafter, submit quarterly reports from her probation officer, submit a copy of her release order when she is released from supervision and have no further contact with the criminal justice system. The motion passed unanimously.

11:45 A.M. IMO Sweet & Sassy Children’s Parties

The Board determined that the violations noted in the Enforcement Bureau reports should be addressed and a Uniform Penalty letter sent to the respondent that they must cease and desist from employing unlicensed people to perform regulated services that fall within the scope of cosmetology and hairstyling such as an Up-do, makeover, fingernail painting, mini-facials and hand treatment. Also, the Experience Practicing Licensee (EPL) or Board Licensee must cease and desist from training unlicensed persons to perform cosmetology and hairstyling services. Additionally, respondent must immediately train all personnel with regard to the regulatory requirements for decontamination, sterilization, sanitation and also provide all the required equipment necessary within all locations of the licensed premise to include the area allocated where the children's services are being provided. The Board also advises that the training should include the awareness of communicable, contagious and infectious diseases. The Board strongly suggests that the use of high school students working as program coordinators be discontinued and replaced with cosmetology and hairstyling students with student permits (senior work permit), that have completed a minimum of 600 hours of training in a vocational school or proprietary school licensed by the Board. Alternatively, they could utilize students who have completed their training and graduated from school and have been issued a temporary work permit while waiting to be scheduled for the Board licensing examination.
