STATE BOARD OF COURT REPORTING
PUBLIC SESSION MINUTES SEPTEMBER 15, 2008
I. APPROVAL OF PUBLIC SESSION MEETING MINUTES OF JULY 21, 2008 A motion was made by Susan Scardilli and seconded by Richard McCormack to approve the Public Session Minutes of July 21, 2008 as amended. A vote was taken and the motion was approved by a unanimous vote. II. EXECUTIVE DIRECTORS REMARKS Executive Director Dianne L. Tamaroglio advised that the next Bankers exam will be held on Monday, November 17, 2008 prior to our scheduled Board meeting and the Certified Realtime Court Reporter’s exam is set for Saturday, October 18, 2008 at Mother Seton Regional High School. Ms. Tamaroglio advised the Board that without a staff person for the Board, it is very difficult in accomplishing all that has to be done. Going through the Reinstatement period with those Certificate holders who didn’t renew on time has been very difficult to say the least. III. BOARD PRESIDENT REMARKS Board President Marianne Cammarota shared an email she received with the Board regarding gifting. A discussion followed regarding gifting and the Board’s regulation pertaining to same. The Board’s discussion resulted in questioning whether there should be any gifting at all even if it is nominal in value. Ms. Cammarota advised the Board that she has been named Chairman of the Council of Academy of Profession Reporters, the Council for professional development and testing. Ms Cammarota also advised the Board the NCRA is looking into whether or not there is a way to give the skills exam on demand. IV. REGULATORY MATTERS
Appearance Patricia Schiripo, Regulatory Analyst The Board reviewed with Regulatory Analyst Patricia Schiripo revisions to NJAC13:43-5.4, Prohibited Practices. This was a perfect tie in with the email brought to the Board’s attention by Board President Marianne Cammarota. Upon review and discussion a motion was made by Jean Dolan and seconded by Susan Scardilli to vote to adopt the regulation with change. A vote was taken and the motion was passed by a unanimous vote. V. OLD BUSINESS A. Susan Pearce-Bates, CCR 30XI00168800 Susan Pearce-Bates, has filed Reinstatement paperwork, paid renewal & reinstatement fees, & has gone through the Criminal History Background Check; her Certification has been reinstated. This was considered informational for the Board. VI. NEW BUSINESS A. State Board of Court Reporting Meeting Dates for 2009 A motion was made by Susan Scardilli and seconded by Jean Dolan to approve the State Board of Court Reporting meeting dates for 2009. A vote was taken and the motion was passed by a unanimous vote. The following are the 2009 meeting dates:

1. The School of Court Reporting The Board reviewed the course materials for the School of Court Reporting’s Realtime and Speedbuilding Seminar. Upon review, a motion was made by Susan Scardilli and seconded by Jean Dolan to approve the following Continuing Education courses and credits. A vote was taken and the motion was passed unanimously.

C. Ratification of Reinstatement Board President Marianna Cammarota previously approved the Reinstatement of Nancy C. Bendish’s Certified Court Reporting Certification. A motion was made by Susan Scardilli and seconded by Jean Dolan to ratify the approval. A vote was taken and the motion was passed by a unanimous vote. Ms. Bendish has a carryover of 5 Continuing Education credits that can be applied towards the requirements for the 2010-2012 renewal. D. Requesting Reinstatement due to Non-Renewal of Certification A motion was made by Susan Scardilli and seconded by Jean Dolan to not hold up reinstatements waiting for the results of Criminal History Background Checks. If any problems result from the background checks, they will be brought to the Board for review. A vote was taken and the motion was passed by a unanimous vote. Due to the fact that the Board does not meet on a monthly basis, a motion was made by Jean Dolan and seconded by Richard McCormack to authorize Board President Marianne Cammarota to approve any reinstatement applications that come in and then they will be brought to the full Board at its next meeting for ratification. A vote was taken and the motion was passed by a unanimous vote. 1. Deborah L. Adoff, CCR 30XI00189700 Having not renewed her Certified Court Reporter’s Certification on time, Deborah L. Adoff’ submitted an application for the Reinstatement of her Certification to the Board. Upon review, with Ms. Adoff’s application complete and having completed 15.5 Continuing Education credits, a motion was made by Susan Scardilli and seconded by Jean Dolan to approve the Reinstatement of Ms. Adoff’s Certified Court Reporting Certification. A vote was taken and the motion was passed by a unanimous vote. Ms. Adoff has a carryover of .5 Continuing Education credits that can be applied to the 2010-2012 biennial renewal. 2. Alison E. Foley, CCR 30XI00147600 Jean Dolan was recused from this matter and moved away from the table. Having not renewed her Certified Court Reporter’s Certification on time, Alison E. Foley submitted an application for the Reinstatement of her Certification to the Board. Upon review, with Ms. Foley’s application complete and having completed 16 Continuing Education credits, a motion was made by Susan Scardilli and seconded by Richard McCormack to approve the Reinstatement of Ms. Foley’s Certification. A vote was taken and the motion was passed by a unanimous vote. Ms. Foley has a carryover of 1 Continuing Education credit that can applied to the 2010-2012 biennial renewal. 3. Nicholas P. Gibernia, CCR 30XI00099000 Having not renewed his Certified Court Reporter’s Certification on time, Nicholas P. Gibernia submitted an application for the Reinstatement of his Certification to the Board. Mr. Gibernia submitted a completed application however, he only submitted proof of having completed 7.5 Continuing Education credits. Mr. Gibernia stated that he attended the CCRA-NJ’s 2007 Seminar but did not provide proof of attendance at same. A motion was made by Susan Scardilli and seconded by Jean Dolan to approve the Reinstatement of Mr. Gibernia’s Certification and advise him that he must provide proof to the Board of the courses he took at the 2007 seminar to receive credit from the Board. A vote was taken and the motion was passed by a unanimous vote. 4. M. Virginia Guinta, CCR 30XI00038100 Having not renewed her Certified Court Reporter’s Certification on time, M. Virginia Guinta submitted an application for the Reinstatement of her Certification to the Board. Upon review, with Ms. Guinta’s application complete and having completed 11.5 Continuing Education credits, a motion was made by Susan Scardilli and seconded by Jean Dolan to approve the Reinstatement of Ms. Guinta’s Certification and grant her a 3 month extension until December 15, 2008 to complete 4.5 Continuing Education credits to meet the CE requirement for renewal. A vote was taken and the motion was passed by a unanimous vote. 5. Meta E. Kelly, CCR 30XI00180300 Having not renewed her Certified Court Reporter’s Certification on time, Meta E. Kelly submitted an application for the Reinstatement of her Certification to the Board. Upon review, with Ms. Kelly’s application complete and having completed 15 Continuing Education credits, a motion was made by Susan Scardilli and seconded by Jean Dolan to approve the Reinstatement of Ms. Kelly’s Certification. A vote was taken and the motion passed by a unanimous vote. 6. Jane Messineo, CCR 30 XI00087300 16 Credits Having not renewed her Certified Court Reporter’s Certification on time, Jane Messineo submitted an application for the Reinstatement of her Certification to the Board. Upon review, with Ms. Messineo’s application complete and having completed 16 Continuing Education credits, a motion was made by Susan Scardilli and seconded by Jean Dolan to approve the Reinstatement of Ms. Messineo’s Certification. A vote was taken and the motion passed by a unanimous vote. Ms. Messineo has a carryover of 1 Continuing Education credit that can be applied to the 2010-2012 biennial renewal. 7. Linda Schaal, CCR 30XI00115200 Having not renewed her Certified Court Reporter’s Certification on time, Linda Schaal submitted an application for the Reinstatement of her Certification to the Board. Upon review, with Ms. Schaal’s application complete and having completed 16 Continuing Education credits, a motion was made by Susan Scardilli and seconded by Jean Dolan to approve the Reinstatement of Ms. Foley’s Certification. The Board granted a retroactive extension to allow Ms. Schaal to use a Case CATalyst Course taken on August 25, 2008 towards this renewal. A vote was taken and the motion passed by a unanimous vote. Ms. Schaal has a carryover of 1 Continuing Education credit that can be applied to the required 15 credits for the 2010-2012 biennial renewal. 8. Adrienne Tisdale-Scott, CCR 30XI00198800 Having not renewed her Certified Court Reporter’s Certification on time, Adrienne Tisdale-Scott submitted an application for the Reinstatement of her Certification to the Board. Upon review, with Ms. Scott’s application complete and having completed 16 Continuing Education credits, a motion was made by Susan Scardilli and seconded by Jean Dolan to approve the Reinstatement of Ms. Scott’s Certification. A vote was taken and the motion passed by a unanimous vote. Ms. Scott has a carryover of 1 Continuing Education credit that can be applied to the required 15 credits for the 2010-2012 biennial renewal. 9. Joanne L. Sekella, CCR 30XI00155300 Having not renewed her Certified Court Reporter’s Certification on time, Joanne L. Sekella submitted an application for the Reinstatement of her Certification to the Board. Upon review, with Ms. Sekella’s application complete and having completed 10 Continuing Education credits, a motion was made by Susan Scardilli and seconded by Jean Dolan to approve the Reinstatement of Ms. Sekella’s Certification and grant her a 3 month extension until December 15, 2008 to complete 5 Continuing Education credits to meet the CE requirement for renewal. A vote was taken and the motion was passed by a unanimous vote. 10. Barbara Smyth, CCR 30XI00206600 Having not renewed her Certified Court Reporter’s Certification on time, Barbara Smyth submitted an application for the Reinstatement of her Certification to the Board. Upon review, with Ms. Smyth’s application complete and having completed 15.5 Continuing Education credits, a motion was made by Susan Scardilli and seconded by Jean Dolan to approve the Reinstatement of Ms. Smyth’s Certification. A vote was taken and the motion was passed by a unanimous vote. Ms. Smyth has a carryover of .5 Continuing Education credit that can be applied to the 2010-2012 biennial renewal. 11. Danielle L. Stevenson, CCR 30XI00204800 Having not renewed her Certified Court Reporter’s Certification on time, Danielle L. Stevenson submitted an application for the Reinstatement of her Certification to the Board. Upon review, with Ms. Stevenson’s application complete and having completed 15.5 Continuing Education credits, a motion was made by Susan Scardilli and seconded by Jean Dolan to approve the Reinstatement of Ms. Stevenson’s Certification. A vote was taken and the motion passed by a unanimous vote. Ms. Stevenson has a carryover of .5 Continuing Education credit that can be applied to the 2010-2012 biennial renewal. 12. Stephen S. Zeitlin, CCR 30XI00126500 Having not renewed his Certified Court Reporter’s Certification on time, Stephen S. Zeitlin submitted an application for the Reinstatement of his Certification to the Board. Upon review, with Mr. Zeitlin’s application complete and having completed 12 Continuing Education credits, a motion was made by Jean Dolan and seconded by Susan Scardilli to approve the Reinstatement of Mr. Zeitlin’s Certification and grant him a 3 month extension until December 15, 2008 to complete 3 Continuing Education credits to meet the CE requirement for renewal. A vote was taken and the motion was passed by a unanimous vote 13. Barbara Johnson, CCR 30XI00034600 Having not renewed her Certified Court Reporter’s Certification on time, Barbara Johnson submitted an application for the Reinstatement of her Certification to the Board. Ms. Johnson’s application was complete however, she did not submit proof of having attended any Continuing Education courses for the period July 1, 2006-June 30, 2008. Ms. Johnson wrote to the Board advising that the NCRA has extended her certification through 2009 and she therefore assumed that her Continuing Education requirements for the renewal of her Certification with this Board had been met. A motion was made by Susan Scardilli and seconded by Jean Dolan to approve the Reinstatement of Ms. Johnson’s Certification and to advise her that she must provide the Board within 5 business days course documentation with the number of credits received for any courses she has taken for this renewal. Ms. Johnson will be advised that disciplinary action may be taken against her for not complying with the Board’s regulations. A vote was taken and the motion was passed by a unanimous vote. 14. Eileen Himmer, CCR 30XI00170900 Having not renewed her Certified Court Reporter’s Certification on time, Eileen Himmer submitted an application for the Reinstatement of her Certification to the Board. Upon review, with Ms. Himmer’s application complete and having completed 24 Continuing Education credits, a motion was made by Susan Scardilli and seconded by Jean Dolan to approve the Reinstatement of Ms. Himmer’s Certification. A vote was taken and the motion was passed by a unanimous vote. Ms. Himmer has a carryover of 5 Continuing Education credits that can be applied to the 2010-2012 biennial renewal. 15. Andrea G. Segal-Wehman,CCR 30XI00088300 Having not renewed her Certified Court Reporter’s Certification on time, Andrea G. Segal-Wehman submitted an application for the Reinstatement of her Certification to the Board. Upon review, with Ms. Wehman’s application complete and having completed 13.5 Continuing Education credits, a motion was made by Susan Scardilli and seconded by Jean Dolan to approve the Reinstatement of Ms. Wehman’s Certification and grant her a 3 month extension until December 15, 2008 to complete 1.5 Continuing Education credits to meet the CE requirement for renewal. A vote was taken and the motion was passed by a unanimous vote. 16. Jacqueline M. Wahler, CCR 30XI00151000 Having not renewed her Certified Court Reporter’s Certification on time, Jacqueline Wahler submitted an application for the Reinstatement of her Certification to the Board. Upon review, with Ms. Wahler’s application complete and having completed 15.5 Continuing Education credits, a motion was made by Susan Scardilli and seconded by Jean Dolan to approve the Reinstatement of Ms. Wahler’s Certification. A vote was taken and the motion was passed by a unanimous vote. Ms. Wahler has a carryover of .5 Continuing Education credit that can be applied to the 2010-2012 biennial renewal. 17. Nadine Marie Bachman-Gazic, CCR 30XI00188300 Having not renewed her Certified Court Reporter’s Certification on time, Nadine Marie Bachman-Gazic submitted an application for the Reinstatement of her Certification to the Board. Upon review, with Ms. Gazic’s application complete and having completed 7 Continuing Education credits, a motion was made by Susan Scardilli and seconded by Jean Dolan to approve the Reinstatement of Ms. Wehman’s Certification and grant her a 3 month extension until December 15, 2008 to complete 8 Continuing Education credits to meet the CE requirement for renewal. A vote was taken and the motion was passed by a unanimous vote. 18. Stacey Orlick, CCR 30XI002267 Having not renewed her Certified Court Reporter’s Certification on time, Stacey Orlick submitted an application for the Reinstatement of her Certification to the Board. Upon review, with Ms. Orlick’s application complete and having completed 8.5 Continuing Education credits, a motion was made by Jean Dolan and seconded by Susan Scardilli to approve the Reinstatement of Ms. Orlick’s Certification and grant her a 3 month extension until December 15, 2008 to complete 6.5 Continuing Education credits to meet the CE requirement for renewal. A vote was taken and the motion was passed by a unanimous vote.
E. Correspondence from Cindy Packevicz Cindy Packevicz, has been residing in Florida and has been working as a Court Reporter since 1985. The State of Florida has no requirements to work as a Court Reporter, except that one is a notary. Ms. Packevicz passed the RPR in 1995. Recently, Ms. Packevicz has relocated to New Jersey and was inquiring about New Jersey ‘s requirements to be a Court reporter. Executive Director Dianne l. Tamaroglio advised her that she would have had to pass the RPR no earlier than May 1, 2006 to become Certified as a Court Reporter. Ms. Packevicz has written to the Board requesting an exception to the Board’s regulations. The Board will advise Ms. Packevicz that while the Board is sympathetic to her issues, it does not have the statutory authority to waive the examination requirement nor do we have reciprocity with other states. Therefore, her request is denied. VI. FOR YOUR INFORMATION A. Confirmation of Realtime Exam date with Sister Regina Martin B. Legislative Report These matters were considered informational for the Board deeming no discussion or decision making. VII. ADJOURNMENT A motion was made by Susan Scardilli and seconded by Jean Dolan to adjourn Public Session at 11:35 P.M. and move into Executive Session at 12:00 P.M. A vote was taken and the motion was passed by a unanimous vote. The Board moved into Executive Session to discuss confidential matters.
