NOTE: Dr. Ricciani left the meeting at 1:25 P.M.

I. FORMAL HEARING:

1. 9:00 A.M. - John Kallis, DMD - In the matter of the suspension or revocation of the license of John Kallis, DMD to practice dentistry in the State of New Jersey.

Dr. Kallis appeared with counsel, Mr. Robert Hille, Esq and James Patuto, Esq. Deputy Attorney General David Puteska appeared on behalf of the State.

Mr. Hille discussed his application for a stay of todays proceedings pending decision of the criminal case. Mr. Puteska requested that the stay be denied. The Board, in a motion by Dr. DeSciscio, seconded by Ms. Delaney, moved to Executive Session for deliberation.

The Board returned to public session and in a motion by Dr. DeSciscio, seconded by Ms. Delaney, denied the request for a stay.

Mr. Puteska and Mr. Hille placed their arguments on the record. Mr. Puteska proceeded with placing the State?s case on the record. He marked items AG1 to AG23 which were accepted into evidence.

Mr. Hille proceeded with his case by marking items R1 to R23 into evidence. He presented the following witnesses:

- Dr. Vincent Carrao
- Dr. Patricia Kallis
- Mr. Michael Struk, Private Investigator
- Dr. DeSilvio

Mr. Puteska cross-examined these witnesses, followed by redirect by Mr. Hille. Closing arguments were placed on the record by Mr. Puteska and Mr. Hille.

The Board in a motion by Ms. Delaney, seconded by Dr. Cappetta, moved to Executive Session for deliberation.

The Board returned to Public Session and in a motion by Dr. Kupiec, seconded by Dr. Hall, temporarily suspended Dr. Kallis? license effective Friday, March 21, 2008 at 5:00 P.M. The Board also determined that for the next two days Dr. Kallis cannot prescribe medications unless it is cosigned by another licensed dentist.
