832nd BUSINESS MEETING OF THE BOARD OF EXAMINERS OF ELECTRICAL CONTRACTORS
(PUBLIC SESSION) - - - MAY 6, 2009

The Board Minutes of May 6, 2009, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of June 3, 2009, or soon thereafter as it may be considered. All requirements of the “Open Public Meetings Act” have been complied with according to N.J.S.A. 10:4-6.

The notice of the meeting has been mailed to the Newark Star Ledger, Camden Courier Post, and the Trenton Times, and also notice has been posted on the Bulletin Board at the office of the Secretary of State, Trenton, New Jersey.

(The civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that he attended thirty-four hours of continuing education has been deleted based upon Mr. Cardillo’s financial and medical hardship as detailed in his written response to the Provisional Order of Discipline).

Page 7, Paragraph 3

(The civil penalty in the amount of $1,500.00 for failing to complete the required 10 hour course of study relating to code and law for the 2006 to 2009 triennial renewal period in violation of N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-1.7 (b & c) has been deleted as Mr. Canavera supplied a copy of his certificate for the completion of the code and law course in response to the Provisional Order of Discipline).

DAG Provost stated that at its April 1, 2009 meeting, the Board discussed William Passione’s, License #11485 (Expired), response to a Provisional Order of Discipline filed November 5, 2008.

DAG Provost also stated that the April 1, 2009 Minutes reflect that Mr. Passione be allowed to reinstate his license and business permit with the payment of proper fees and documentation. However, the Board should consider not allowing Mr. Passione to reinstate his license and business permit until such time as he pays his penalty. Mr. Passione failed to satisfy the prior Final Order of Discipline and was issued a second Provisional Order of Discipline for obtaining permits while his license and business permit were expired.

Motion made by Mr. Constantinos Papademas and seconded by Mr. Joseph F. Cantalupo, and passed, that Mr. Passione not be allowed to reinstate his License and Business Permit #11485 until such time as he pays the balance ($300.00) of the initial civil penalty assessed and one third of the civil penalty assessed in the amount of $3,500.00. Mr. Passione may pay the remainder of his penalty in monthly installments of not less than $400.00.

Mr. Richard T. Aicher, Jr. opposed the motion.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve (23) Changes in Business Permits effective May 6, 2009 to March 31, 2012.

Check in the amount of $9,265.00 received from Joseph C. Chickachop, License #4847, t/a Chick-A-Chop Electrical Contractors, as the second and final installment of a civil penalty in the amount of $13,765.00 for violation of N.J.S.A. 45:5A-17; N.J.A.C. 13:31-1.4; N.J.A.C. 13:31-3.2; N.J.A.C. 13:45A-15.2(a)10; N.J.A.C. 13:31-3.7; N.J.A.C. 13:45C-1.2,1.3; N.J.A.C. 13:31-3.4; and N.J.S.A. 45:1-21(b).

The Board accepted the payment.

Personal Money Order in the amount of $250.00 received from David D’Acqua, Unlicensed, as the first and final payment of a civil penalty in the amount of $250.00 for violation of N.J.S.A. 45:5A-9(a) and N.J.S.A. 56:8-1 et seq. Mr. D’Acqua signed an agreement to cease and desist from engaging in the business of electrical contracting.

The Board accepted the payment and signed cease and desist agreement.

Postal Money Order in the amount of $50.00 received from James H. Gandy, Unlicensed, as the twenty-second installment of a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.A.C. 13:31-3.3. Payments started May 25, 2007 and the balance due is $300.00.

The Board accepted the payment.

Letter dated April 22, 2009, received from Andrew J. Chalmers, Blue Star Services, LLC, requesting a two month continuance of business under Permit #11839.

The current six-month extension will expire on June 8, 2009 and Mr. Chalmers needs this additional time to ensure that the proper paperwork for the new licensee is complete and in the Board office for its review on June 3, 2009.

Motion made by Mr. James H. Flaherty and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, that a letter be sent to Mr. Chalmers advising him that pursuant to N.J.S.A. 45:5A-14 the firm of Blue Star Services, LLC. has been granted a second six-month continuance of business under permit #11839.

At its March 4, 2009 meeting, the Board reviewed the following matter:

Letter dated February 23, 2009, received from Adam J. Bird, License #15092, requesting a six-month continuance of business under Permit #14015 according to N.J.S.A. 45:5A-14. The licensee, William M. Bird, (License #14015) is currently in rehabilitation after having surgery. Mr. Bird stated that he will be overseeing all work performed by WMC Inc., t/a Wes Jones and Son Electrical Contractors. (Adam J. Bird does not have a business permit)

Adam Bird is also requesting an extension to allow William to complete his Continuing Education Courses for the 2009 to 2012 renewal period.

Letter dated March 16, 2009, received from Vincent K. McInerney, M.D.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, that William M. Bird, License #14015 be granted an additional six months to complete the remaining continuing education course hours.

Mr. Bird will also be advised that pursuant to N.J.S.A. 45:5A-14 the firm of WMC Inc., t/a Wes Jones and Son Electrical Contractors, has been granted a six-month continuance of business under permit #14015.

Letter dated March 27, 2009, received from Thomas W. Crooks, License #8388, t/a T C Electrical Contractors, Inc., requesting an extension to complete his Continuing Education Courses for the 2009 to 2012 renewal period.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, that a letter be sent to Mr. Crooks advising him that his request is denied. Mr. Crooks will be requested to provide copies of continuing education certificates for the courses he has attended to date.

Letter dated April 17, 2009, received from Vincent G. Gleason, Jr., License #7553, t/a Gleason Electric, LLC, requesting an extension to complete his Continuing Education Courses for the 2009 to 2012 renewal period.

Letter dated May 4, 2009, received (via facsimile) from Mr. Gleason stating that he has completed his 34 hours of continuing education; therefore, he no longer seeks an extension to complete same.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Mitchell R. Malec, and unanimously passed, that a letter be sent to Mr. Gleason requesting that he forward to the Board copies of his Continuing Education Course Certificates totaling 34 hours for the 2009 to 2012 triennial renewal period.

At its March 4, 2009 meeting, the Board reviewed a letter received February 9, 2009, from Paul J. Giovinazzo, License #1140, t/a Rose City Electric Co., Inc., requesting a waiver of the Continuing Education Courses pursuant to N.J.A.C. 13:31-1.7.

The Board denied Mr. Giovinazzo’s request pending receipt of additional information concerning his illness. The Board would like to know how long Mr. Giovinazzo has been under a doctor’s care; the approximate date he became incapacitated and the number of hours he can remain in a seated position.

In response to the Board’s request, a letter dated April 6, 2009, was received from Mr. Giovinazzo.

Motion made by Mr. James H. Flaherty and seconded by Mr. Mitchell R. Malec, and unanimously passed, that a letter be sent to Mr. Giovinazzo advising him that his request for a waiver is denied. However, Mr. Giovinazzo will be granted an extension to complete his Continuing Education Courses; this extension will expire on December 31, 2009. Additionally, Mr. Giovinazzo will be requested to advise the Board how he is able to operate his electrical contracting business.

Letter received March 26, 2009 from Frank Knight, License #9930, t/a Frank Knight Electrical Contractor, requesting an extension to complete his Continuing Education courses for the 2009 to 2012 renewal period.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Mitchell R. Malec, and passed, that Deputy Attorney General Ginger R. Provost prepare a Consent Order directing that Mr. Knight pay a civil penalty in the amount of $1,000.00 for violation of N.J.A.C. 13:31-1.7 which shall be stayed should Mr. Knight complete his continuing education courses within the sixty-day (60) day extension granted to him.

Mr. James H. Flaherty abstained from the motion.

Letter dated April 27, 2009, received from William Fanning, License #15481, t/a Chamberlin Electric, requesting an extension to complete his Continuing Education courses for the 2009 to 2012 renewal period.

Motion made by Mr. Richard T. Aicher, Jr. and seconded by Mr. Mitchell R. Malec, and unanimously passed, that Deputy Attorney General Ginger R. Provost prepare a Consent Order directing that Mr. Fanning pay a civil penalty in the amount of $1,000.00 for violation of N.J.A.C. 13:31-1.7 which shall be stayed should Mr. Fanning complete his continuing education courses within the sixty-day (60) day extension granted to him.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Kenneth F. Cerullo, Esq., The Commercial Agency, Inc.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, that Mr. Cerullo’s request is held in abeyance pending a description in the difference between the two hour course and the three hour course.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Marcel Renson, ECSP 057.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve the previously approved courses and instructor(s) along with two new courses and instructor(s). Mr. Renson will be advised that the approval of the courses entitled “Fire Pump Requirements” and “Fire Rating & Fire Walls” are being denied as they do not appear to be specific to electrical contractors.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from John A. Drebitko, ECSP 118.

Additionally, Mr. Drebitko will be advised that his request to transfer courses approved under another sponsor is being held in abeyance pending receipt of a separate request listing all courses he wishes to have under his sponsorship.

Response received from Grant E. Buford, License #13692, to the Provisional Order of Discipline filed February 6, 2009, ordering that Mr. Buford pay a civil penalty in the total amount of $2,850.00. Mr. Buford was penalized $250.00 ($62.50 for each hour of Continuing Education he failed to attend) for violation of N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:1-1.7(b & c); civil penalty in the amount of $100.00 for failing to retain or provide required course documentation for the 2006 to 2009 triennial renewal period in violation of N.J.A.C. 13:31-1.7(f); civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that the required continuing education requirement was complete for the 2006 to 2009 triennial period by June 30, 2006, in violation of N.J.A.C. 13:31-1.7(a); a public reprimand is imposed upon Mr. Buford for violation of N.J.S.A. 1-21a, N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-7(a, b, c & f) and Mr. Buford must complete all missing course hours within six months from the date of the Order pursuant to N.J.S.A. 45:1-22.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Richard T. Aicher, and unanimously passed, that Deputy Attorney General Ginger R. Provost draft a letter to Mr. Buford advising him that the Board will reconsider his request upon receipt of certificates totaling 42 hours (34 hours and 8 carry over hours).

James D. Cestone, License #11310, failed to respond to the Provisional Order of Discipline filed February 6, 2009, ordering that Mr. Cestone pay a civil penalty in the total amount of $5,600.00. Mr. Cestone was penalized $1,500.00 ($62.50 for each hour of Continuing Education he failed to attend) for violation of N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:1-1.7(b & c); civil penalty in the amount of $100.00 for failing to retain or provide required course documentation for the 2006 to 2009 triennial renewal period in violation of N.J.A.C. 13:31-1.7(f); civil penalty in the amount of $1,500.00 for failing to complete the required 10 hour course of study relating to code and law for the 2006 to 2009 triennial renewal period in violation of N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-1.7 (b & c); civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that the required continuing education requirement was complete for the 2006 to 2009 triennial period by June 30, 2006, in violation of N.J.A.C. 13:31-1.7(a); a public reprimand is imposed upon Mr. Cestone for violation of N.J.S.A. 1-21a, N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-7(a, b & c) and Mr. Cestone must complete all missing course hours within six months from the date of the Order pursuant to N.J.S.A. 45:1-22.

Provisional Order of Discipline was sent to Mr. Cestone certified and regular mail. Certified mail was signed for, regular mail was not returned.

Motion made by Mr. James H. Flaherty and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, that Deputy Attorney General Ginger R. Provost finalize the Provisional Order of Discipline and issue a Final Order of Discipline ordering that Mr. Cestone pay a civil penalty in the total amount of $5,600.00. Victor Aligo, License #10516, failed to respond to the Provisional Order of Discipline filed February 6, 2009, ordering that Mr. Aligo pay a civil penalty in the total amount of $4,000.00. Mr. Aligo was penalized civil penalty in the amount of $1,500.00 for failing to complete the required 10 hour course of study relating to code and law for the 2006 to 2009 triennial renewal period in violation of N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-1.7 (b & c); civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that the required continuing education requirement was complete for the 2006 to 2009 triennial period by June 30, 2006, in violation of N.J.A.C. 13:31-1.7(a); a public reprimand is imposed upon Mr. Aligo for violation of N.J.S.A. 1-21a, N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-7(a, b & c) and Mr. Aligo must complete all missing course hours within six months from the date of the Order pursuant to N.J.S.A. 45:1-22.

Provisional Order of Discipline was sent to Mr. Aligo certified and regular mail. Certified mail was returned “Unclaimed”, regular mail was not returned. No response received.

Motion made by Mr. James H. Flaherty and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, that Deputy Attorney General Ginger R. Provost finalize the Provisional Order of Discipline and issue a Final Order of Discipline ordering that Mr. Aligo pay a civil penalty in the total amount of $4,000.00. Mr. Aligo was penalized $1,500.00 for failing to complete the required 10 hour course of study relating to code and law for the 2006 to 2009 triennial renewal period in violation of N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-1.7 (b & c); civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that the required continuing education requirement was complete for the 2006 to 2009 triennial period by June 30, 2006, in violation of N.J.A.C. 13:31-1.7(a); a public reprimand is imposed upon Mr. Aligo for violation of N.J.S.A. 1-21a, N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-7(a, b & c) and Mr. Aligo must complete all missing course hours within six months from the date of the Order pursuant to N.J.S.A. 45:1-22.

Letter dated April 9, 2009, received from Jack Kennedy, President, Electrical Installation & Design, Inc., stating that there are many companies installing solar panels without being licensed to do so. Mr. Kennedy also stated that all facets of these systems should be performed by a licensed electrical contractor.

Mr. Kennedy further stated that the State should and must require that all work is performed by a licensed electrical contractor, whether the project is public or private.

Motion made by Mr. Richard T. Aicher, Jr. and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, that Mr. Kennedy be advised that it is the opinion of the Board that Solar Photovoltaic Array Modular Panels are clearly electrical equipment that emits a voltage of more than ten volts; therefore, the installation of these panels would not be considered exempt work and must be installed by a licensed electrical contractor who holds a business permit. Therefore, should he be aware of any job sites where the photovoltaic systems are being installed, he should forward all information to the Board for investigation.

The Board also requested that this information be related to the Department of Community Affairs and the Department of Treasury.

Letter dated April 7, 2009, received from Jill E. Nagy, Esq., on behalf of Gregory A. Sarangoulis, requesting that the Board accept his test scores from either Pennsylvania, Maryland or Delaware rather than require Mr. Sarangoulis take the electrical contractor’s examination in New Jersey. Ms. Nagy also stated that the licensee utilized for the companies business interests in New Jersey has been forced to retire due to heath reasons. Ms. Nagy also stated that because the next available test date is not until July 2009, Mr. Sarangoulis would suffer a hardship.

The Board reviewed copies of certificates received from Robert Bonica, License #13265, as directed by the Final Order of Discipline filed April 1, 2009.

The Board directed that a letter be sent to Mr. Bonica directing him to forward to the Board copies of his Continuing Education Course Certificates totaling 34 hours for the 2006 to 2009 triennial renewal period.

At its March 4, 2009 Meeting, the Board reviewed a response received from Armen Chaparian, Jr., License #9013, to the Provisional Order of Discipline filed February 6, 2009, ordering that Mr. Chaparian pay a civil penalty in the total amount of $2,875.00. Mr. Chaparian was penalized $375.00 ($62.50 for each hour of Continuing Education he failed to attend) for violation of N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:1-1.7(b & c); civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that he attended thirty-four hours of continuing education; a public reprimand is imposed upon Mr. Chaparian for violation of N.J.S.A. 1-21a, N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-7(a, b & c) and Mr. Chaparian must complete all missing course hours within six months from the date of the Order pursuant to N.J.S.A. 45:1-22. The Board voted to finalize the Provisional Order of Discipline and issue a Final Order of Discipline.

At its March 11, 2009 Closed Session Meeting, the Board approved Armen Chaparian’s, License #9013, request to be allowed to pay his penalty in monthly installments in the minimum amount of $500.00.

Motion made by Mr. Joseph Cantalupo and seconded by Mr. James H. Flaherty, and unanimously passed, that the Board approve Mr. Chaparian’s request to pay his penalty in monthly installments in the minimum amount of $500.00.

The Board reviewed applications for the written examination to be administered by Thomson Prometric. Twenty (20) applications were approved.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Mitchell R. Malec, and unanimously passed, that the Board go into Executive Closed Session to consider and to review consumer complaints, investigative reports and other information received pursuant to the Board’s investigative authority in order to determine whether violations of the law, including Board regulations have occurred. The results of the deliberations will be made known when and if the Board determines to initiate disciplinary action or other law enforcement action.
