The Board Minutes of June 3, 2009, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of July 1, 2009, or soon thereafter as it may be considered. Letter dated June 1, 2009, received from Mark H. Cheeseman, Vice President, George Sparks, Inc., requesting a second six-month continuance of business under Permit #5133 according to N.J.S.A. 45:5A-14. The licensee, Charles P. Sparks died on May 23, 2009. Mr. Cheeseman stated that Greg Sparks will supervise the work being performed.

Cantalupo and seconded by Mr. Constantinos Papademas, and unanimously passed, that a letter be sent to Mr. Sparks advising him that pursuant to N.J.S.A. 45:5A-14 the firm of George Sparks, Inc. has been granted a second six-month continuance of business under Permit #5133.

Maryann Sheehan, Regulatory Analyst, Director’s Office, appeared before the Board to discuss N.J.A.C. 13:31-1.7 Continuing Education Regulations.

Mr. Schooley stated that the Board would like to change the regulation which stipulates that continuing education courses must be approved each renewal cycle. Mr. Schooley also stated that once the courses are approved, it is the opinion of the Board that the sponsors should not have to reapply for each renewal cycle as long as the courses remain the same. New subject matter will still be reviewed by the Board.

Mrs. Sheehan asked whether or not sponsors already approved would pay the required fee without course submission of previously approved courses.

Mr. Schooley stated that sponsors would be required to pay this fee because submissions still have to be processed and documentation is sent to the sponsor.

Mr. Malec stated that the Board has reviewed the courses and instructor resumes; therefore, the course material does not need to be reviewed again. The application would still need to be completed to ensure the contact information is up to date.

Mrs. Sheehan stated that she will research the Board’s request.

The Board discussed the matter of the $60.00 journeyman registration fee and the $100.00 journeyman registration reinstatement fee.

The Board requested that the Qualified Journeyman Electrician Identification regulation be amended as it is the Board’s opinion that the reinstatement fee is excessive.

Mrs. Sheehan stated that in regards to Assembly Bill No. A928 (previously Assembly Bill No. A4127), which was strongly opposed by the Board, is now in the Assembly for discussion.

Mrs. Sheehan also stated that Assembly Bill No. A3317 has passed both houses and is on the governor’s desk for signature. This Bill was reviewed by the Board which, in its original version, required employees of the state, municipality, county, or school district working on premises occupied by a firm or corporation and performed by a regular employee to be a qualified journeyman electrician. The Board supported this bill. However, the bill was amended to include “or if the person holds a civil service title that includes a description of electrical work” they can be a qualified journeyman electrician or licensed as an electrical contractor. Therefore, if a civil service title does not include electrical work, the individual would need to be a qualified journeyman electrician.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Larry Logan, ECSP 035.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve Mr. Logan’s request to transfer courses approved under another sponsor to be conducted under his sponsorship. The Board also approved twelve (12) new courses and instructor(s) along with the previously approved courses and instructor(s).

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Erica Evanko, Specified Technologies, Inc.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve three (3) new courses and instructors. The courses entitled “Firestop Instruction Training Level 1" and “Firestop Instructional Training 2" are not approved as they do not meet the criteria of continuing education pursuant to N.J.A.C. 13:31-1.7.

The Board reviewed a memorandum dated May 5, 2009, received from Darlene Kane, Budget Officer, Division of Consumer Affairs, stating that for the third quarter of Fiscal Year 2009, the Electrical Board/Committee was directly billed for 150.8 hours of Deputy Attorney General/Paralegal services totaling $21,328.21.

Letter dated May 19, 2009, received from Robert A. Shoremount, License #6998 (Inactive), requesting a waiver of the Continuing Education Courses pursuant to N.J.A.C. 13:31-1.7.

Mr. Shoremount stated that he wishes to activate his License #6998, but has been unable to find continuing education courses needed in order to reactivate his license for the 2009 to 2012 renewal period.

Motion made by Mr. Constantinos Papademas and seconded by Mr. Mitchell R. Malec, and unanimously passed, that a letter be sent to Mr. Shoremount advising him that his request is denied. In order to reinstate his License #6998 he must take 34 hours of continuing education courses. Mr. Shoremount will also be advised that he may submit the documentation concerning the courses he has taught to possibly receive credit up to 15 hours.

Signed acknowledgment received from Frederick G. Dries, License #11930, who agrees to the entry of a formal reprimand against him for violation of N.J.S.A. 45:5A-9 which states that a licensee shall not be entitled to qualify more than one person for a business permit.

At its May 6, 2009 meeting, the Board reviewed documentation received from Rachel Franklin who is applying for a Telecommunications Wiring Exemption Certificate.

Ms. Franklin telephoned the Board office requesting permission to appear before it concerning the Board’s decision to deny her application.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Mitchell R. Malec, and unanimously passed, that Ms. Franklin be allowed to appear before it during the Open Session portion of the meeting.

The Board reviewed applications for the written examination to be administered by Thomson Prometric. Twenty-two (22) applications were approved.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, that the Board go into Executive Closed Session to consider and to review consumer complaints, investigative reports and other information received pursuant to the Board’s investigative authority in order to determine whether violations of the law, including Board regulations have occurred. The results of the deliberations will be made known when and if the Board determines to initiate disciplinary action or other law enforcement action.
