834th BUSINESS MEETING OF THE BOARD OF EXAMINERS OF ELECTRICAL CONTRACTORS
(PUBLIC SESSION) - - - JULY 1, 2009 The Board Minutes of July 1, 2009, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of September 2, 2009, or soon thereafter as it may be considered. All requirements of the “Open Public Meetings Act” have been complied with according to N.J.S.A. 10:4-6. The notice of the meeting has been mailed to the Newark Star Ledger, Camden Courier Post, and the Trenton Times, and also notice has been posted on the Bulletin Board at the office of the Secretary of State, Trenton, New Jersey.
Meeting of July 1, 2009, was called to order at 9:00 A.M.
Mr. Joseph P. Schooley, Chairman Marian Fiore, Sr. Management Assistant, was present from 9:00 A.M. until the close of the meeting. Kathleen Moran, Administrative Assistant, III, was present from 9:00 A.M. until the close of the meeting. Ginger R. Provost, Deputy Attorney General, Division of Law, was present from 9:00 A.M. until the close of the meeting. David Braun, Joseph Auffenbacher and Aileen Dumlao, Interns, Division of Law, were present. Also in attendance were Robert Jules, Central Jersey Electrical League and Robert Rose, New Jersey State Electrical League. ******************** The Board saluted the Flag. ******************** Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve (22) Initial Licenses effective July 1, 2009 to March 31, 2012. Motion made by Mr. Joseph F. Mr. Richard T. Aicher, Jr. nominated Mr. Joseph P. Schooley, and the nomination was seconded by Mr. James H. Flaherty. Let the record reflect that Mr. Schooley has been elected Chairman for the Board from this date until the July 2010 meeting. ******************** Check in the amount of $4,750.00 received from Saleh Amer, License #14164, as the first and final payment of a civil penalty in the amount of $4,750.00 for violation of N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:31-1.7 (a, b & c). The Board accepted the payment. ******************** Check in the amount of $2,875.00 received from Armen Chaparian, Jr., License #9013, as the first and final payment of a civil penalty in the amount of $2,875.00 for violation of N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:31-1.7 (a, b & c). The Board accepted the payment. ******************** Check in the amount of $2,500.00 received from Rocco Tropeano, License #15931, as the first and final payment of a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9. The Board accepted the payment. ******************** Postal Money Order in the of amount of $50.00 received from James H. Gandy, Unlicensed, as the twenty-third installment of a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.A.C. 13:31-3.3. Payments started May 25, 2007 and the balance due is $250.00. The Board accepted the payment. ******************** Check in the amount of $10,000.00 received from Joseph C. Chickachop, License #4847, t/a Chick-A-Chop Electrical Contractors, as the first and final payment of a civil penalty in the amount of $10,000.00 for violation of N.J.A.C. 13:45C-1.2 and 1.3. The Board accepted the payment. ******************** Check in the amount of $250.00 received from Fred Rebelein, Unlicensed, as the first installment of a civil penalty in the amount of $1,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq. The balance due is $1,250.00 The Board accepted the payment. ******************** Check in the amount of $500.00 received from Carl Doran, Unlicensed as the first installment of a civil penalty in the amount of $1,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq. The balance due is $1,000.00 The Board accepted the payment. ******************** Two checks in the amounts of $25.00 received from Frank D’Arpa, License #8778, as the forty-third and forty-fourth installment of a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq. Payments started September 25, 2002 and the balance due is $1,400.00. The Board accepted the payment. ******************** Letter dated June 17, 2009, received from Pamela R. Kowitski, PKR Electrical Contractors, Inc., requesting a six-month continuance of business under Permit #7731 according to N.J.S.A. 45:5A-14. The licensee, Robert G. Kowitski, died on May 16, 2009. Mrs. Kowitski stated that her son, Anthony, will soon submit his application to take the electrical contractor’s examination. Motion made by Mr. James H. Flaherty and seconded by Mr. Constantinos Papademas, and unanimously passed, that a letter be sent to Mrs. Kowitski advising her that pursuant to N.J.S.A. 45:5A-14 the firm of PKR Electrical Contractors, Inc. has been granted a six-month continuance of business under Permit #7731. ******************** Letter dated June 5, 2009, received from Bruce M. Rockwell, License #12974, requesting twenty-two hours of credit towards the renewal of his License #12974 pursuant to N.J.A.C. 13:31-1.7. Mr. Rockwell is reinstating his License #12974 which expired on March 31, 2009. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, that Mr. Rockwell be granted 15 credits towards his 2009 to 2012 triennial license renewal. Since Mr. Rockwell has attended fourteen (14) hours of continuing education courses, he needs 5 more hours of continuing education courses in order to reinstate his License #12974. ******************** The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Jean Francis, New Jersey Electrical Contractors Association. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve three (3) new courses and instructor(s), and previously approved courses. ******************** The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Mervin Munoz, IEC Chesapeke. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve thirteen (13) new courses and instructor(s). The courses entitled “Master’s Prep Course” and “NABCEP PV Entry Level Certificate of Knowledge Prep” are disapproved as they do not meet the criteria of continuing education pursuant to N.J.A.C. 13:31-1.7. ******************** Mr. Richard T. Aicher, Jr., recused himself from the discussion and the motion because of his business relationship with the IBEW. The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Mr. Reisser, IBEW Local 269 - JACT. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve three (3) new courses and instructor(s), and previously approved courses. ******************** The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Salvatore Ferrara, Electrical Training Center, Inc. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve (9) new courses and instructor(s) and previously approved courses. ******************** The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Ramon Lopez, Electrical Training Course. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve (9) new courses and instructor(s) and previously approved courses. ******************** Raymond J. McCausland, License #9560 (Expired), has failed to respond to an Administrative Action Provisional Order of Discipline filed May 6, 2009, ordering that Mr. McCausland pay a civil penalty in the amount of $2,000.00 for violation of N.J.A.C. 13:45C-1.2; Mr. McCausland’s license and business permit, should he reapply for reinstatement, are provisionally denied until such time as he responds fully to the Board’s request for information and otherwise meets all qualifications for renewal; and a public reprimand is hereby provisionally imposed upon him. Provisional Order of Discipline sent to Mr. McCausland certified and regular mail. Certified mail returned “Unclaimed”, regular mail not returned. Memorandum dated May 7, 2009, received from Christine A. Green, Investigator, III, Enforcement Bureau, stating that she served upon Mr. McCausland the Administrative Action Demand for Surrender of Pressure Seal. Ms. Green stated that Mr. McCausland advised her that the pressure seal was returned to the Board. Office files do not reflect the receipt of the pressure seal issued to R J McCausland III Electrical Contractor. Motion made by Mr. James H. Flaherty and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, that Deputy Attorney General Ginger R. Provost finalize the Provisional Order of Discipline and issue a Final Order of Discipline ordering that Mr. McCausland pay a civil penalty in the amount of $2,000.00 for violation of N.J.A.C. 13:45C-1.2; Mr. McCausland’s license and business permit, should he reapply for reinstatement, are denied until such time as he responds fully to the Board’s request for information and otherwise meets all qualifications for renewal; and a public reprimand is hereby imposed upon him. Additionally, the Board directed that a letter be sent the Subcode Officials in the surrounding communities to advise that Mr. McCausland’s License and Business Permit #9560 are expired. ******************** Joseph DeLuca, License #10276, has failed to respond to an Administrative Action Provisional Order of Discipline filed May 6, 2009, ordering that Mr. DeLuca pay a civil penalty in the amount of $2,000.00 for violation of N.J.A.C. 13:45C-1.2; license and business permit are provisionally suspended until such time as he responds fully to the Board’s request for information; upon finalization of the Order Mr. DeLuca is to return the pressure seal issued to JDL Electrical Contracting Company, Inc.; and a public reprimand is provisionally imposed upon him. Provisional Order of Discipline sent to Mr. DeLuca certified and regular mail. Certified mail signed for, regular mail not returned. No response received. Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. James H. Flaherty, and unanimously passed, that Deputy Attorney General Ginger R. Provost finalize the Provisional Order of Discipline and issue a Final Order of Discipline ordering that Mr. DeLuca pay a civil penalty in the amount of $2,000.00 for violation of N.J.A.C. 13:45C-1.2; license and business permit are suspended until such time as he responds fully to the Board’s request for information; upon finalization of the Order Mr. DeLuca is to return the pressure seal issued to JDL Electrical Contracting Company, Inc.; and a public reprimand is imposed upon him. Additionally, the Board directed that a letter be sent the Subcode Officials in the surrounding communities to advise that Mr. DeLuca’s License and Business Permit #10276 are suspended. ******************** Signed cease and desist agreements were received from Carl Doran, Pennsville, New Jersey and Fred R. Rebelein, Bridgewater, New Jersey. Signed cease and desist agreement received from Richard Johns, Nite Time Decor, Plainfield, New Jersey, agreeing to include the language in his advertisement that all electrical work is “performed by licensed electrical contractors”. The Board accepted the signed cease and desist agreements. ******************** Letter dated June 3, 2009, received from John A. MacCalus, Manager, District Office Services, Office of the Executive Director, Office of Legislative Services, along with four Telecommunication Wiring Exemption Applications. Mr. MacCalus stated that with the passage of Assembly Bill #A3317, non-union, non-Civil Service titled State Workers in the area of telecommunications and IT networking will no longer be exempt from obtaining telecommunications wiring permits and electrical permits for work in State owned or occupied buildings. This matter is being held abeyance pending a legal opinion. ******************** At its February 4, 2009 meeting, Richard T. Aicher, Jr. advised the Board, via a telephone conversation, that Technical Educational Services are advising licensees that a license and business permit are not needed to install solar panels. Mr. Flaherty stated that the Board has previously clarified that the installation of solar panels must be performed by a licensed electrical contractor with an active business permit. The Board directed that a letter be sent to Technical Educational Services directing that they notify each attendee that inaccurate information was provided to them concerning the installation of solar panels. The Board requests that Technical Educational Services advise each attendee that it is the opinion of the Board of Examiners of Electrical Contractors that Solar Photovoltaic Array Modular Panels are clearly electrical equipment that emits a voltage of more than ten volts; therefore, the installation of these panels would not be considered exempt work and must be installed by a licensed electrical contractor who holds a business permit. Copy of the letter, and a listing of the attendees receiving such a letter, was received from Joseph J. Bello, Educational Director, Technical Educational Services, LLC. The Board accepted the letter from Mr. Bello. ******************** Letter dated June 19, 2009, received from Henry E. Skala requesting reinstatement of his License #5368 which he failed to renew for the triennial renewal periods of April 1, 2000 to March 31, 2003; April 1, 2003 to March 31, 2006; April 1, 2006 to March 31, 2009; and April 1, 2009 to March 31, 2012. Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, that a letter be sent to Mr. Skala advising him that in order to regain his License #5368 he must take and pass the electrical contractor’s examination. ******************** Mr. Schooley stated that the Board office is receiving many telephone calls concerning the application for the re-registration of Qualified Journeyman Electrician. Ms. Fiore stated that individuals are advising Board staff that because they work for the union, applying for the card is a conflict of the collective bargaining agreement. Ms. Fiore also stated that these individuals are advising that they do not know what job they will be doing until they report to the licensed electrical contractor. Mr. Aicher stated if the individual is working as a regular employee of a firm or corporation pursuant to N.J.S.A. 45:5A-18 or an individual is supervising ten or more employees at a job site, that individual must first register as a qualified journeyman electrician. Mr. Schooley stated that a licensee whose license is “inactive” would be required to apply for the qualified journeyman’s electrician card. ******************** At its March 4, 2009 meeting, the Board reviewed a response received from Carmine S. Berardinelli, License #13873, to the Provisional Order of Discipline filed February 6, 2009, ordering that Mr. Berardinelli pay a civil penalty in the total amount of $4,000.00. Mr. Berardinelli was issued a civil penalty in the amount of $1,500.00 for failing to complete the required ten hour course in violation of N.J.A.C. 45:5A-13.1 et seq and N.J.A.C. 13:1.1.7 (b and c); civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that he attended thirty-four hours of continuing education; a public reprimand is imposed upon Mr. Berardinelli for violation of N.J.S.A. 1-21a, N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-7(a, b & c); and Mr. Berardinelli must complete all missing course hours within six months from the date of the Order pursuant to N.J.S.A. 45:1-22. Deputy Attorney General Ginger R. Provost stated that in regards to Mr. Berardinelli, the Board decided that a Final Order of Discipline be drafted rescinding the Provisional Order of Discipline and order Mr. Berardinelli to pay a civil penalty in the amount of $100.00 for his failure to fully cooperate with the Board’s audit letter by supplying the requested documentation. DAG Provost also stated that a new Provisional Order of Discipline would need to be issued because the failure to fully cooperate with the Board was not reflected in the original POD. DAG Provost further stated that because Mr. Berardinelli did provide the certificates in response to the audit, the Board may withdraw the POD and issue a letter of reprimand or caution without assessing a civil penalty. Mr. Malec stated that the fine is important as there was no need for clarification; the audit requested copies of continuing education certificates totaling 34 hours. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, that the original Provisional Order of Discipline be withdrawn and a revised Provisional Order of Discipline be issued ordering that Mr. Berardinelli pay a civil penalty in the amount of $100.00 for violation of N.J.A.C. 13:45C-1.2 for failing to supply the documentation initially requested. ******************** Rachel Franklin appeared before the Board concerning its decision to disapprove her application for a Telecommunications Wiring Exemption. Mr. Schooley stated for the record that this discussion is taking place in Open Session. The Board will not comment on Ms. Franklin’s request today. If the Board does have questions, Ms. Franklin has the option of either answering or not answering its questions. Ms. Franklin stated that her husband is not working at this time and the approval of this application would assist them financially. Ms. Franklin also stated that her husband has ten years of experience performing telecommunications work. Ms. Franklin stated that it was an act of honesty for something she feels she is still being punished for. Ms. Franklin also stated that her indiscretion was a total lack of common sense as she put her trust in something she should not have. Ms. Franklin further stated that she has fulfilled all of the requirements placed upon her; and is making restitution for which she has been given five years. Ms. Franklin stated that she is having financial trouble and is not allowed an extension to pay the restitution. Ms. Franklin also stated that the denial of her application is the only obstacle which is preventing her from performing telecommunications in small town libraries. Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Constantinos Papademas, and unanimously passed, to go into Executive Closed Session to discussion this matter. After discussion in Closed Session, the following motion was made. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Joseph F. Cantalupo, and passed, that Ms. Franklin’s Telecommunications Wiring Exemption Certificate be approved with the condition that Ms. Franklin provide proof of restitution to the Board every six months.
Mr. Richard T. Aicher, Jr. - No Motion carries. Application for Telecommunications Wiring Exemption Certificate has been approved and a Consent Order will be issued regarding the conditions to be placed upon the applicant. Ms. Franklin thanked the Board for their time. ******************** Mr. Schooley stated that DAG Provist is retiring. Mr. Schooley also stated that the Board wishes her good health and happiness. DAG Provost stated that it has been a pleasure working with the Board. DAG Provost also stated that Joseph Donofrio will counsel the Board after she retires. ******************** The Board reviewed applications for the written examination to be administered by Thomson Prometric. Twenty-three (23) applications were approved. ******************** Motion made by Mr. Mitchell R. Malec and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, that the Board go into Executive Closed Session to consider and to review consumer complaints, investigative reports and other information received pursuant to the Board’s investigative authority in order to determine whether violations of the law, including Board regulations have occurred. The results of the deliberations will be made known when and if the Board determines to initiate disciplinary action or other law enforcement action. Meeting adjourned at 2:30 P.M.
