(PUBLIC SESSION) - - - SEPTEMBER 2, 2009 The Board Minutes of September 2, 2009, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of October 7, 2009, or soon thereafter as it may be considered. All requirements of the “Open Public Meetings Act” have been complied with according to N.J.S.A. 10:4-6. The notice of the meeting has been mailed to the Newark Star Ledger, Camden Courier Post, and the Trenton Times, and also notice has been posted on the Bulletin Board at the office of the Secretary of State, Trenton, New Jersey.
Meeting of September 2, 2009, was called to order at 9:00 A.M.
Mr. Joseph P. Schooley, Chairman Mr. Joseph P. Schooley was present until 2:45 P.M. reviewing applications for examination. Marian Fiore, Sr. Management Assistant, was present from 9:00 A.M. until the close of the meeting. Kathleen Moran, Administrative Assistant, III, was present from 9:00 A.M. until the close of the meeting. Joseph Donofrio, Deputy Attorney General, Division of Law, was present from 9:00 A.M. until the close of the meeting. Also in attendance was Oscar Ortiz. ******************** The Board saluted the Flag. ******************** Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve (35) Initial Licenses effective September 2, 2009 to March 31, 2012. Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve (8) Changes in Business Permits effective September 2, 2009 to March 31, 2012. ******************** Checks in the amounts of $250.00 each received from Fred Rebelein, Unlicensed, as the second and third installment of a civil penalty in the amount of $1,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq. Payments started June 15, 2009 and the balance due is $750.00. The Board accepted the payment. ******************** Check in the amount of $150.00 received from Greg Cardillo, License #15000, as the first installment of a civil penalty in the amount of $3,000.00 for violation of N.J.S.A. 45:5A-13.1; N.J.S.A. 45:1-21(a); and N.J.A.C. 13:1-7 (a, b & c). The balance due is $2,850.00. The Board accepted the payment. ******************** Cashiers check in the amount of $150.00 received from Ronald Masterson, License #9128, as the first installment of a civil penalty in the amount of $1,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 45:5A-15. The balance due is $1,350.00. The Board accepted the payment. ******************** Check in the amount of $1,000.00 received from Alberto Maracio, Unlicensed, as the first and final payment of a civil penalty in the amount of $1,000.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq. Additionally, Mr. Maracio signed an agreement to cease and desist from engaging in the business of electrical contracting in the State of New Jersey until such time as he becomes licensed to do so. The Board accepted the payment. ******************** Cashiers check in the amount of $7,500.00 received from Vincent R. Stahl, License #8760, as the first and final payment of a civil penalty in the amount of $7,500.00 for violation of N.J.S.A. 45:5A-15. Additionally, Mr. Stahl provided copies of Continuing Education Course Certificates totaling 34 hours for the 2006 to 2009 triennial renewal period. The Board accepted the payment. ******************** Check in the amount of $100.00 received from Paul Canavera, License #11095, as the first installment of a civil penalty in the amount of $3,312.50 for violation of N.J.S.A. 45:1-21(a); N.J.S.A. 45:5A-13.1; and N.J.A.C. 13:31-1.7 (a, b & c). Balance due is $3,212.50. The Board accepted the payment. ******************** Letter dated July 9, 2009, received from Ann A. Beggs requesting a “third” six-month continuance of business under Permit #1789 according to N.J.S.A. 45:5A-14. The licensee, George R. Beggs, died on June 9, 2008. At its February 4, 2009 meeting, the Board granted a six-month continuance of business under permit #1789. Mrs. Beggs was advised that because the licensee died on June 9, 2008, the six-month extension would be considered a “second extension”. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, that a letter be sent to Mrs. Beggs advising her that pursuant to N.J.S.A. 45:5A-14 the firm of Beggs Electrical Company has been granted an additional three-months continuance of business under permit #1789. Mrs. Beggs will also be advised that this is the final extension granted to Beggs Electrical Company. ******************** Letter dated July 30, 2009, received from Charles A. Burns, III, Executive Vice President, JJ White, Inc., requesting a six-month continuance of business under Permit #3256 according to N.J.S.A. 45:5A-14. The licensee, John E. White, died on March 9, 2009. Mr. Burns stated that Anthony Frangelli has submitted an application for approval to take the electrical contractors examination in January 2010. Motion made by Mr. James H. Flaherty and seconded by Mr. Mitchell R. Malec, and unanimously passed, that a letter be sent to Mr. Frangelli advising him that pursuant to N.J.S.A. 45:5A-14 the firm of JJ White, Inc. has been granted a six-month continuance of business under permit #3256. ******************** The Board reviewed the comments and responses concerning the re-adoption of the Fire Alarm, Burglar Alarm and Locksmith Advisory Committee’s Rules. Motion made by Mr. James H. Flaherty and seconded by Mr. Mitchell R. Malec, and unanimously passed, that the Board approves the committee’s recommendations for the re-adoption of its rules. ******************** The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from John Lyle, Griffith Electric. Cantalupo, and passed, to approve ten (10) new courses and instructor(s). ******************** At its May 6, 2009 meeting, the sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Kenneth F. Cerullo, Esq., The Commercial Agency, Inc. The Board requested that Mr. Cerullo clarify the difference between the two hour course and the three hour course. In response to the Board’s request, a letter dated July 14, 2009, was received from Mr. Cerullo. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve four (4) new courses and instructor(s). ******************** The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Edward Sofield. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve five (5) new courses and instructor(s), and the previously approved courses and instructor(s). ******************** The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Suzanne Borek, DCA. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve the previously approved courses and instructor(s). The Board also approved Ms. Borek’s request to shorten the courses entitled "Other Codes for the Electrical Contractor" and "Electrical Inspections". The course entitled "Fire Pumps" was not approved as further explanation is needed to show the difference between the one hour and four hour course. ******************** The Board reviewed a memorandum dated July 31, 2009, received from Darlene Kane, Budget Officer, Division of Consumer Affairs, stating that for the fourth quarter of Fiscal Year 2009, the Electrical Board/Committee was directly billed for 180.9 hours of Deputy Attorney General/Paralegal Services totaling $23,120.80. ******************** Proposal for N.J.A.C. 13:31-5.1 “Registration as Qualified Journeyman Electrician” was published in the New Jersey Register on July 6, 2009. ******************** Letter dated July 24, 2009, received from Andrew Goldman who is applying to take the electrical contractor’s examination. DAG Donofrio stated that the Board denied Mr. Goldman’s application to take the electrical contractor’s examination based on his qualifications. Mr. Goldman’s argument is that his degree in Electrical Technology is equivalent to a bachelor’s degree. Mr. Flaherty stated that a degree in engineering technology is not the same as electrical engineering as the content of the subjects is different. The Board requested that Deputy Attorney General Donofrio send a letter to Mr. Goldman advising him that he does not meet the qualifications to take the electrical contractor’s examination. Mr. Goldman will be advised that in order to qualify to take the electrical contractor’s examination he must provide a bachelor’s degree in electrical engineering; not a degree in electrical engineering technology. Mr. Goldman will also be advised that his hands-on experience must be immediately preceding the submission of his application. ******************** E-Mail dated July 6, 2009, received from Michael Kennedy, License #12575, who is employed as a maintenance foreman at Merck & Co, Inc. Mr. Kennedy stated that he is also the holder of a Qualified Journeyman Electrician registration certificate and is requesting clarification concerning the new regulation. The Board requested that a letter be sent to Mr. Kennedy advising him that employees of Merck & Company performing electrical work on site must be either a licensed electrical contractor or a Qualified Journeyman Electrician as used in N.J.S.A. 45:5A-18(k). Additionally, every ten employees who are performing electrical work at a job site shall be supervised by a licensed electrical contractor or by a qualified journeyman electrician. ******************** The Board reviewed the Agenda for MSEIA which indicates that the NJ BPU NJCEP and MSEIA will appeal the Board’s ruling that photovoltaic panels must be performed by a licensed electrical contractor who holds a business permit. The Board directed that this matter be placed on the next Agenda for further discussion. ******************** The following matters were held in abeyance and will be discussed at a future meeting. Mr. Ortiz also stated that he submitted the requested information and was denied again as it did not appear that he was employed full time. Mr. Ortiz stated that he has worked through Trade Source and has the required five years of experience to take the examination. Mr. Schooley advised Mr. Ortiz that in order to substantiate five years of experience full time, he may submit copies of W-2 income tax forms. Upon receipt of this information, the Board will again review Mr. Ortiz’s application. Mr. Ortiz stated that he will forward the requested documentation for the Board’s review. ******************** The Board reviewed applications for the written examination to be administered by Thomson Prometric. ******************** Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, that the Board go into Executive Closed Session to consider and to review consumer complaints, investigative reports and other information received pursuant to the Board’s investigative authority in order to determine whether violations of the law, including Board regulations have occurred. The results of the deliberations will be made known when and if the Board determines to initiate disciplinary action or other law enforcement action. Meeting adjourned at 2:00 P.M.
