(PUBLIC SESSION) - - - OCTOBER 7, 2009 The Board Minutes of October 7, 2009, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of November 4, 2009, or soon thereafter as it may be considered. All requirements of the “Open Public Meetings Act” have been complied with according to N.J.S.A. 10:4-6. The notice of the meeting has been mailed to the Newark Star Ledger, Camden Courier Post, and the Trenton Times, and also notice has been posted on the Bulletin Board at the office of the Secretary of State, Trenton, New Jersey.

Mr. Joseph P. Schooley, Chairman Mr. Constantinos Papademas and Mr. James H. Flaherty were absent. Marian Fiore, Sr. Management Assistant, was present from 9:00 A.M. until the close of the meeting. Kathleen Moran, Administrative Assistant, III, was present from 9:00 A.M. until the close of the meeting. Joseph Donofrio, Deputy Attorney General, Division of Law, was present from 9:00 A.M. until the close of the meeting. ******************** The Board saluted the Flag. ******************** Motion made by Mr. Richard T. Aicher, Jr. and seconded by Mr. Mitchell R. Malec, and unanimously passed, to approve (24) Initial Licenses effective October 7, 2009 to March 31, 2012. Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve (20) Initial Business Permits effective October 7, 2009 to March 31, 2012. Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Mitchell R. Malec, and unanimously passed, to approve (4) Initial Business Permits Previously Expired effective October 7, 2009 to March 31, 2012. The Board accepted the payment. ******************** Check in the amount of $4,000.00 received from Martin J. Dean, License #14689, as the first and final payment of a civil penalty in the amount of $4,000.00 for violation of N.J.S.A. 45:1-21(a), N.J.S.A. 45:5A-13.1, and N.J.A.C. 13:31-1.7(a, b, & c). The Board accepted the payment. ******************** Check in the amount of $5,500.00 received from Frank M. Bachman, License #8591, as the first and final payment of a civil penalty in the amount of $3,000.00 for violation of N.J.S.A. 45:1-21(a), N.J.S.A. 45:5A-13.1, N.J.A.C. 13:31-1.7(a, b, & c). The Board accepted the payment. ******************** Check in the amount of $50.00 received from Maria DiGregorio, on behalf of Salvatore Minneci, Unlicensed, as the first and final payment of a civil penalty in the amount of $50.00 for violation of N.J.S.A. 45:5A-9. The Board accepted the payment. ******************** Check in the amount of $500.00 received from Philip Aguglia, Unlicensed, t/a The Basement Store, as the first and final payment of a civil penalty in the amount of $500.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq. Additionally, Mr. Aguglia signed an agreement to cease and desist from engaging in and/or advertising his availability to engage in the business of electrical contracting in the State of New Jersey until such time as he becomes licensed to do so. The Board accepted the payment. ******************** The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Arnold Olender, A & A Electrical Educational Services, LP. Cantalupo, and unanimously passed, to approve ten (10) new courses and instructor(s). ******************** The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Tom Pernal. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, to approve twenty (20) new courses, and instructor(s), and previously approved courses. ******************** The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Richard F. Van Wert, Electric Education Center. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, to approve one (1) new course and instructor, and previously approved courses. ******************** The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Lawrence S. Cross, III. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, to approve previously approved courses and instructor(s). ******************** The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Louis Roselle. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, to approve one (1) new course and instructor. ******************** The Board reviewed a memorandum dated September 16, 2009, and the Fiscal Year 2009 Final Budget Report, received from Darlene Kane, Budget Officer. ******************** Maryann Sheehan, Regulatory Analyst, Director’s Office, reviewed with the Board a draft of N.J.A.C. 13:31-1.7(I) which states that a sponsor of a course or program offering that has been previously approved by the Board shall reapply to the Board for approval of the course or program if there are any changes to the course content, hours of instruction, or course lecturer. The sponsor shall resubmit to the Board the documentation and continuing education sponsor fee set for in N.J.A.C. 13:31-1.7 (h 2 & 5). If there are no changes in course content, hours of instruction, or course lecturer for a previously approved course or program, the sponsor shall not be required to reapply to the Board for approval prior to offering the course or program in a subsequent renewal period. Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, that the Board accepts the above proposed language for publication in the New Jersey Register. ******************** Mrs. Sheehan stated that the Board did not receive any comments on the proposed amendment to N.J.A.C. 13:31-5.1 Qualified Journeyman Electrician which states that an applicant for a qualified journeyman electrician registration has acquired 8,000 hours of practical experience working with tools in the installation, alteration, or repair of wiring for electric light, heat, or power, which work shall have been done in compliance with the National Electrical Code, and who has had a minimum of 756 classroom hours of related instruction. Motion made by Mr. Richard T. Aicher, Jr. and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, that N.J.A.C. 13:31-5.1 “Qualified Journeyman Electrician” be adopted without change. ******************** Mrs. Sheehan stated that the Board had requested that the $100.00 Qualified Journeyman Electrician Identification registration reinstatement fee be amended as it was the Board’s opinion that the reinstatement fee is excessive. Mrs. Sheehan stated that these are standardized fees which cannot be amended. ******************** Response received from Gerald Umansky, License #7537, in response to a Provisional Order of Discipline ordering that he pay a civil penalty in the amount of $5,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating he completed 34 hours of continuing education; N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:31-1.7(b & c) $62.50 for each hour not completed; N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:31-1.7 (b & c) for failing to complete the ten hour course of study; N.J.A.C. 13:31-1.7(a) for failing to maintain certificates; and a public reprimand is provisionally imposed for violation of N.J.S.A. 1-21 (a & h), N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:31-1.7(a, b , & c). Malec, and unanimously passed, that DAG Donofrio finalize the Provisional Order of Discipline and issue a modified Final Order of Discipline ordering that Mr. Umansky pay a civil penalty in the amount of $100.00 for violation of N.J.A.C. 13:31-1.7(a) for failing to maintain certificates and a public reprimand is imposed upon Mr. Umansky for violation of N.J.S.A. 1-21 (a & h), N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:31-1.7(a, b , & c). ******************** Response received from Howard Shapiro, License #1905, to the Provisional Order of Discipline filed July 27, 2009, ordering that he pay a civil penalty in the amount of $2,750.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating he completed 34 hours of continuing education; N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:31-1.7(b & c) $62.50 for each hour not completed; and a public reprimand is provisionally imposed for violation of N.J.S.A. 1-21 (a & h), N.J.S.A. 45:5A-13.1 et seq, and N.J.A.C. 13:31-1.7 (a, b &c). Paternoster, License #5549, to the Provisional Order of Discipline filed July 28, 2009, ordering that he pay a civil penalty in the amount of $5,062.50 for violation of N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:31-1.7 (b & c) for failing to complete the ten hour course of study; N.J.A.C. 13:31-1.7(a) for falsely stating he completed 34 hours of continuing education; N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:31-1.7(b & c) $62.50 for each hour not completed; and a public reprimand is provisionally imposed for violation of N.J.S.A. 1-21(a & h), N.J.S.A. 45:5A-13.1 et seq, and N.J.A.C. 13:31-1.7(a, b &c). Richey, License #11112, to the Provisional Order of Discipline filed July 28, 2009, ordering that he pay a civil penalty in the amount of $4,000.00 for violation of N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:31-1.7 (b & c) for failing to complete the ten hour course of study; N.J.A.C. 13:31-1.7(a) for falsely stating he completed 34 hours of continuing education; and a public reprimand is provisionally imposed for violation of N.J.S.A. 1-21(a & h), N.J.S.A. 45:5A-13.1 et seq, and N.J.A.C. 13:31-1.7(a, b &c). Additionally, the Board directed that a letter be sent to Bill Harris, ECSP 070, advising him if a licensee requests a duplicate copy of his Continuing Education Course Certificate, he is not to supply the licensee with sign-in sign-out attendance sheets. Mr. Harris will be requested to provide licensees with a duplicate certificate. ******************** Response received from James N.
