The Board Minutes of November 4, 2009, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of December 2, 2009, or soon thereafter as it may be considered. All requirements of the “Open Public Meetings Act” have been complied with according to N.J.S.A. 10:4-6.

The notice of the meeting has been mailed to the Newark Star Ledger, Camden Courier Post, and the Trenton Times, and also notice has been posted on the Bulletin Board at the office of the Secretary of State, Trenton, New Jersey.

Meeting of November 4, 2009, was called to order at 9:00 A.M.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve (7) Initial Licenses effective November 4, 2009 to March 31, 2012.

Motion made by Mr. Richard T. Aicher, Jr. and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, to approve (10) Initial Business Permits effective November 4, 2009 to March 31, 2012.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve (5) Initial Business Permits Previously Expired effective November 4, 2009 to March 31, 2012.

Motion made by Mr. Richard T. Aicher, Jr. and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, to approve (6) Changes in Business Permits effective November 4, 2009 to March 31, 2012. The Board directed that the business permit file of a licensee who has changed the business name four times or more be reviewed by it before the new business name is approved.

Check in the amount of $5,500.00 received from Colin G. Clausson, License #8004, as the first and final payment of a civil penalty in the amount of $5,500.00 for violation of N.J.A.C. 13:31-1.7(a), N.J.S.A. 45:5A-13.1, N.J.A.C. 13:31-1.7 (b, c & d), and N.J.S.A. 45:1-21 (a & h).

The Board accepted the payment.

Letter dated October 27, 2009, received from Timothy Kohlheim requesting a six-month continuance of business under Permit #9286 according to N.J.S.A. 45:5A-14. The licensee, Walter Kohlheim, died on October 13, 2009.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, that the Board go into Executive Closed Session to discuss this matter.

After discussion in closed session the Board made the following motion:

Motion made by Mr. Mitchell R. Malec and seconded by Mr. James H. Flaherty, and unanimously passed, that Timothy Kohlheim’s request is denied. The Board directed that a letter be sent to Thomas J. Orr, Executor, requesting that he provide Mr. Kohlheim’s qualifications; a list of employees and their qualifications; and a list of current jobs. Mr. Orr will also be advised that Mr. Kohlheim should not contract any new jobs and may hire a licensed electrical contractor, who holds a business permit, or hire a qualified journeyman electrician registered with the Board, to continue the business until such time as the Board approves Mr. Kohlheim’s request.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Joseph P. Kempker

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve four (4) new courses and an instructor, and previously approved courses.

Additionally, a letter is to be sent to Mr. Kempker advising him that the Board does not approve on-line courses at this time.

Mr. Flaherty stated that perhaps the Board should look into the possibility of allowing on-line courses in the future. With the age of technology, there may be way to monitor the licensees attending these courses.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve eight (8) new courses and instructor(s), and previously approved courses.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Joseph J. Bevacqua.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve twenty-five (25) new courses and instructor(s), and previously approved courses. The sub-committee is not approving Suzanne Borek as an instructor as she is not listed to teach a specific course.

Romano, License #13381, failed to respond to a Provisional Order of Discipline filed July 28, 2009, ordering that he pay a civil penalty in the amount of $2,750.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating he completed 34 hours of continuing education; N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:31-1.7(b & c) $62.50 for each hour not completed; and a public reprimand is provisionally imposed for violation of N.J.S.A. 1-21 (a), N.J.S.A. 45:5A-13.1 et seq, and N.J.A.C. 13:31-1.7 (a, b & c).

Aicher, Jr., and unanimously passed, that DAG Donofrio finalize the Provisional Order of Discipline and Issue a Final Order of Discipline ordering that Mr. Romano pay a civil penalty in the amount of $2,750.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating he completed 34 hours of continuing education; N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:31-1.7(b & c) $62.50 for each hour not completed; and a public reprimand is provisionally imposed for violation of N.J.S.A. 1-21 (a), N.J.S.A. 45:5A-13.1 et seq, and N.J.A.C. 13:31-1.7 (a, b & c).

Malec, and unanimously passed, that DAG Donofrio finalize the Provisional Order of Discipline and Issue a Final Order of Discipline ordering that Mr. Nicolella pay a civil penalty in the amount of $4,000.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating he completed 34 hours of continuing education; N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:31-1.7 (b & c) for failing to complete the required ten hour course of study; and a public reprimand is provisionally imposed for violation of N.J.S.A. 1-21 (a), N.J.S.A. 45:5A-13.1 et seq, and N.J.A.C. 13:31-1.7 (a, b & c).

The Board reviewed applications for the written examination to be administered by Thomson Prometric. Forty-three (43) applications were approved.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, that the Board go into Executive Closed Session to consider and to review consumer complaints, investigative reports and other information received pursuant to the Board’s investigative authority in order to determine whether violations of the law, including Board regulations have occurred. The results of the deliberations will be made known when and if the Board determines to initiate disciplinary action or other law enforcement action.
