BOARD OF EXAMINERS OF ELECTRICAL CONTRACTORS The notice of this meeting was prepared in the Office of the Board and mailed to the Secretary of State, the Star Ledger, the Trenton Times and the Courier Post. CALL TO ORDER The meeting of the Fire Alarm, Burglar Alarm and Locksmith Advisory Committee was called to order by Chairman Robert Shoremount at 9:30 a.m. in the Hudson Room, Sixth Floor, 124 Halsey Street, Newark, New Jersey. All parties were duly notified of the date, time and location of this meeting and pertinent material was provided to meeting participants. Attendees recited the Pledge of Allegiance prior to the roll call of members. ROLL CALL Committee Members Present:

Scott Fischbein ANNOUNCEMENTS - Mr. DeLuca informed the Committee that he has submitted another request for Committee members Boyer and Shoremount to attend the Master Locksmiths Association meeting. The new request is for their attendance at the meeting to be held on May 19, 2008. - Mr. DeLuca has submitted requests for the Continuing Education subcommittee to be compensated for its review of continuing education in February and March. Mr. DeLuca hasn’t been advised whether payment will be made. - Staff has prepared approximately 30 business license applications and 1 individual license application for Committee review. - An Investigative Inquiry is scheduled for this morning at 10 a.m. - Regulatory Analyst Maryann Sheehan has requested that she meet with the Committee at the May 20, 2008 meeting with regard to the adoption of the Late Fee and Reinstatement Fee rule that was formally proposed in the December, 2007. Also, The Committee’s rules sunset on March 15, 2009. Mrs. Sheehan will also discuss the process during her appearance before the Committee. APPROVAL OF MINUTES FOR THE FEBRUARY 19, 2008 MEETING Approval of minutes is tabled until the May 20, 2008 meeting. CHAIRMAN’S REPORT Chairman Shoremount expressed his concern with regard to clarification of the requirements for qualification as an Unsupervised Employee: Have successfully completed a total of four hours of training in the Barrier Free Subcode, N.J.A.C. 5:23-7, the New Jersey Uniform Construction Code, N.J.A.C. 5:23, exclusive of the Barrier Free Subcode, and the Americans with Disabilities Act Code, 36 C.F.R. § 1191, four hours of training in basic electronics and four hours of training in trade-related subjects, or have successfully passed a competency examination administered by the Committee, or have obtained a Certified Registered Locksmith rating by the Associated Locksmiths of America. (N.J.A.C. 13:31A-27(b)2, Locksmith Unsupervised Employee); and Have successfully completed two hours of training in the Barrier Free Subcode, N.J.A.C. 5:23-7, two hours of training in the New Jersey Uniform Construction Code, N.J.A.C. 5:23, exclusive of the two hours of training in the Barrier Free Subcode, two hours of training in the Americans with Disabilities Act Code, 36 C.F.R. § 1191, two hours of training in industrial safety, and 32 hours of training in trade-related subjects relevant to the field, or shall have successfully passed a competency examination administered by the Committee (N.J.A.C. 13:31A-3.6 A, Alarm Unsupervised Employee). After discussion, it was determined that the matter will be included for review during the meeting with Regulatory Analyst Maryann Sheehan on May 20, 2008. EXECUTIVE DIRECTOR’S REPORT Executive Director presented a sample of the Wall Certificate that will be issued to licensed businesses. Introduction To Access Control, 2 hours (CodeTECES) The instructor for the programs was also recommended for approval. Courses are approved for in person training only. (A review of the sponsor’s web site provides much evidence of on-line continuing education). The sponsor must indicate how mandatory requirements for attendance certification will be complied with prior to offering the continuing education on-line. The following seminar was not approved since the content is not applicable to burglar alarm, fire alarm, or locksmith licensing: P.I. Skills - Skip Tracing (2 hours) Motion was made by Charles Okun, seconded by Keith Eaves and unanimously determined to approve the continuing education programs recommended for approval by the Continuing Education subcommittee.

Gerald Donofrio, COM-TEC Security Systems, Municipal License Fees The Advisory Committee reviewed correspondence submitted by Mr. Donofrio with regard to an alarm licensing fee imposed by Maple Shade Township. Motion was made by Charles Okun, seconded by Keith Eaves and unanimously passed to request that Deputy Attorney General Donofrio send correspondence to Maple Shade Township to inform the township with regard to the prohibition of the licensing of alarm and locksmith businesses by municipal and county governments, additionally, that N.J.S.A. 45:5A-36 supercedes existing municipal licensing regulations. PUBLIC COMMENTS Chris Mack, a member of the New Jersey Burglar Alarm and Fire Alarm Association, asked when the Committee will provide a listing of continuing education sponsors and programs. Mr. Mack was informed that a listing is being developed for posting on the Committee’s web site. Scott Fischbein, a member of the New Jersey Burglar Alarm and Fire Alarm Association, inquired with regard to the status of the Committee’s business licensing process. Mr. Fischbein was informed that licenses will be issued in the form of a wall certificate. REVIEW OF APPLICATIONS FOR ALARM AND LOCKSMITH BUSINESS LICENSES The Advisory Committee reviewed the applications of alarm and locksmith businesses ADJOURNMENT Motion was made by Edward Bagniewski, seconded by Arthur Fucetola and unanimously passed to adjourn the Public Session at 10:45 a.m.
