HEARING AID DISPENSERS EXAMINING COMMITTEE
PUBLIC SESSION MINUTES
FEBRUARY 13, 2009

ROLL CALL

PRESENT Charles A. Herb, Bruce Romanczuk, Jack Ivey, Jennifer Schaal Melvin Snyder and David Weesner

ALSO PRESENT Renee P. Clark, Executive Director Sonia Claudino, Administrative Staff Debra Levine, DAG

CALL TO ORDER The regular bimonthly meeting of the Hearing Aid Dispensers Examining Committee was called to order at 124 Halsey Street at 10:00 a.m., all members having been notified of the time, date and place, and materials pertinent hereto having been provided.

SUNSHINE LAW In compliance with Chapter 231 the Public Law of 1975, notice of this meeting was given to the Trenton Times, the Star Ledger, the Courier-Post and the Record.

I APPROVAL OF MINUTES

November 7, 2009

A motion was made by Charles Herb, seconded by David Weesner to accept the minutes as written with minor changes. The motion carried by unanimous vote.

II CORRESPONDENCE

Chair directed that a letter be sent to Janet Macguire in response her question regarding how long a hearing test is valid to be used for sale and fitting of a hearing instrument. Committee states that although Statutes and Regulations do not have a specific regulation regarding evaluation and testing prior to 12 months, it is the Committee’s advice to use best practices and judgement to perform tests as needed.

III QUESTION FROM DEPUTY DIRECTOR

In regards to the Deputy Director’s question as to whether the Boards believe the number of hours necessary to fulfill the mandate of Continuing Education hours is appropriate. Committee responds that Hearing Aid dispensing is a highly technical evolving field. Therefore, the Committee is content with the current continuing education requirements of 20 hours every two years.

Jennifer Schaal made a motion to proceed to Executive Session, seconded by Bruce Romanczuk, to consider and review advertisement, consumer complaints and other information received pursuant to the Committee’s investigative authority in order to determine whether violations of law, including Committee regulations, have occurred. The results of these deliberations will be made known when, and if, the Committee determines to initiate disciplinary or other enforcement actions. If the Committee chooses to issue a Uniform Penalty Letter, the action will be taken in Public Session immediately after the Executive Session.
