PUBLIC SESSION MINUTES
APRIL 17, 2009

ROLL CALL

CALL TO ORDER The regular bimonthly meeting of the Hearing Aid Dispensers Examining Committee was called to order at 124 Halsey Street at 10:00 a.m., all members having been notified of the time, date and place, and materials pertinent hereto having been provided.

SUNSHINE LAW In compliance with Chapter 231 the Public Law of 1975, notice of this meeting was given to the Trenton Times, the Star Ledger, the Courier-Post and the Record.

I APPROVAL OF MINUTES

February 13, 2009

A motion was made by Charles Herb, seconded by David Weesner to accept the minutes as written. The motion carried by unanimous vote.

II LICENSING EXAMINATION

A motion was made by Jack Ivey, seconded by Charles A. Herb to make September 21, 2009 the next licensing examination. The motion carried by unanimous vote.

III CORRESPONDENCE

The Committee reviewed correspondence from Nancy Schneider regarding “Grace’s Law”. A motion was made by David Weesner, seconded by Bruce Romanczuk to approve the answers to the following charts:

As the governing body for all licensed hearing aid dispensers in New Jersey, in the Committee’s opinion, which of the following would you consider to be part of the “hearing aid” as defined by this law (e.g., likely to be included in the fee charged for the “hearing aid”) and which are likely to be billed for separately? I have created a chart below to try to categorize as many likely charges that I could think of. Please include any items you feel are appropriate, in addition to those listed in the grid below that would be applicable to children, ages 15 and younger.

Of the following list, what professional services would you consider to be “medically necessary” expenses incurred in the purchase of a hearing aid as noted in the language of “Grace’s Law?” Again, please add any items you feel are missing in regards to amplification services for children age 15 and younger.

Jennifer Schaal made a motion to proceed to Executive Session, seconded by Bruce Romanczuk, to consider and review advertisement, consumer complaints and other information received pursuant to the Committee’s investigative authority in order to determine whether violations of law, including Committee regulations, have occurred. The results of these deliberations will be made known when, and if, the Committee determines to initiate disciplinary or other enforcement actions. If the Committee chooses to issue a Uniform Penalty Letter, the action will be taken in Public Session immediately after the Executive Session.
