CALL TO ORDER

The meeting of the Home Inspection Advisory Committee was called to order by Chairman Michael Del Greco at 9:50 a.m. in the Hunterdon Conference Room, sixth floor, 124 Halsey Street, Newark, New Jersey. All parties were duly notified of the time, date and place and all pertinent material had been provided.

SUNSHINE LAW ANNOUNCEMENT

Michael Del Greco read the statement required by Chapter 231, Laws of 1975, known as the Open Public Meetings Act, and announced that notice of the meeting was prepared in the office of the Committee and mailed to the Secretary of State, the Star-Ledger, the Courier Post, the Bergen Record and the Atlantic City Press.

APPEARANCE BY PATRICIA SCHIRIPO, REGULATORY ANALYST

Ms. Schiripo appeared before the Committee to discuss N.J.A.C. 13:40-15.11, regarding a change of license status from inactive to active and N.J.A.C. 13:40-15.1, regarding reinstatement of suspended licenses. After discussing these regulations, the Committee, on a motion by Vice-Chairman Casper, seconded by Committee Chairman Del Greco, voted to amend its pending rule proposal to include the following:

N.J.A.C. 13:40-15.11 - Change of licensure status: inactive to active:

N.J.A.C. 13:40-15.11(a)(2) - For a license has been inactive for a period of two years but less than five (5) years, he/she will be required to complete 60 units of continuing education within the three year period immediately preceding the reinstatement application. The Committee voted to delete the option that the licensee could take the course of study as required by N.J.A.C. 13:40-15.5(a)(3).

N.J.A.C. 13:40-15.11(a)3 - If the license has been inactive for a period of five or more years, he/she will be required to complete twenty (20) units of continuing education per year to a maximum of 120 credits within the three year period immediately preceding the reinstatement application.

N.J.A.C. 13:40-15.12 - Reinstatement of suspended license:

N.J.A.C. 13:40-15.12(d)2 - For a license has been administratively suspended for failure to renew his/her license for a period of two years but less than five (5) years, he/she will be required to complete 60 units of continuing education within the three year period immediately preceding the reinstatement application. The Committee voted to delete the option that the licensee could take the course of study as required by N.J.A.C. 13:40-15.5(a)(3).

N.J.A.C. 13:40-15.12(d)2 - For a license has been administratively suspended for failure to renew his/her his/her license for a period of five (5) or more years, he/she will be required to complete twenty (20) units of continuing education per year to a maximum of 120 credits within the three year period immediately preceding the reinstatement application and will have to successfully pass the required initial licensure examination.

APPROVAL OF MINUTES

The Committee reviewed the minutes of February 10, 2009 and, on a motion by Vice-Chairman Casper, seconded by Chairman Del Greco, voted to approve the minutes as amended.

These statistics were noted for the record.

b. Continuing Education Units

On a motion by Vice-Chairman Casper, seconded by Chairman Del Greco, voted to approve the continuing education report as noted.

c. Incoming Correspondence

Mr. Dixon has requested additional time to complete his continuing education units.

After reviewing this matter and on a motion by Vice-Chairman Casper, seconded by Chairman Del Greco, the Board voted to notify Mr. Dixon that he was granted a six (6) month extension to complete his continuing education units and to review the statutes and regulations related to the profession of home inspection, and to consult with an attorney if he has additional questions regarding these authorities and their application.

On a motion by Vice-Chairman Casper, seconded by Chairman Del Greco, the Committee voted to approve the following applicants for licensure:

On a motion by Chairman Del Greco, seconded by CM Casper, the Committee voted to approve the following applications, pending verification of insurance and/or an advisement not to repair the homes inspected.

On a motion by Vice Chairman Casper, seconded by Chairman Del Greco, the Committee unanimously voted to approve the following continuing education courses with the corresponding number of professional development hours (PDH):

INFORMATIONAL ITEMS

Senate Bill #1805 - Permits the removal of a State Board, Commission, or independent authority member for failure to attend three consecutive meetings thereof without good cause.

The Committee, on a motion by Vice Chairman Casper, seconded by Chairman Del Greco voted to support this bill.

Assembly Bill #3765 - Establishes an 18 month moratorium on the promulgation of new administrative rules and issuance of new policy circular letters by State agencies.

The Committee, on a motion by Vice Chairman Casper, seconded by Chairman Del Greco, voted to support this bill.

PUBLIC COMMENTS

MOVE TO EXECUTIVE SESSION

On a motion by Chairman Del Greco, seconded by Vice Chairman Casper, the Committee voted to enter into Executive Session.

RETURN TO PUBLIC

On a motion contained in the Executive Session minutes, the Committee re-entered into Public Session for the purposes of adjournment.

ADJOURNMENT

On a motion by Chairman Del Greco, seconded by Vice Chairman Casper, the Committee voted to adjourn the meeting at 3:00 PM.
