APPROVAL OF MINUTES

New Jersey State Board of Mortuary Science Open Minutes for February 3, 2009 and march 3, 2009.

On motion made by Mr. Lombardi, seconded by Mr. Wimberg, the Board voted to accept the minutes as read. All voted in favor of the motion.

EXECUTIVE DIRECTOR'S REPORT

Mr. Mandeville reported that the total number of complaints received in March are 7 and the total for 2009 is 14.

Mr. Mandeville reported that the next regular Board meeting has been scheduled for Tuesday, May 5, 2009 in the Hudson Conference Room, 6th floor.

On motion made by Ms. Churchman, seconded by Mr. McCriskin, the Board determined to accept the committee report as read. All voted in favor of the motion.

CORRESPONDENCE

New Jersey Cemetery Board Public Session Agenda for March 12, 2009. This was for the Board’s information only.

Attorney Gerald Neski, informs the Board of the death of Rulon Brooks Jr. and the closing of the Brooks West Side Funeral Home. This was for the Board’s information only.

Catherine Burns Mc Donough, obituary notice appeared in the March 4, 2009 edition of the Star Ledger. This was for the Board’s information only.

OPEN DISCIPLINARY MATTERS

#00-55 Garden Hill Funeral Directors Service Inc., Orange, Mgr., Betty Hill, submitted final payment on the Consent Order that was filed on January 9, 2007. This was for the Board’s information only.

#08-39 The Family Funeral Home LLC, Newark, Mgr., Kenneth Cattenhead, failed to respond to the Board’s decision to uphold the penalty of $2,500.00 for violation of N.J.S,A. 45:1-7 © and 45:7-61. On motion made by Mr. Lombardi, seconded by Mr. McCriskin, the Board directed DAG Berger to issue a subpoena requesting Mr. Cattenhead appearance for an investigative inquiry on May 19, 2009 at 11:00 A.M. All voted in favor of the motion.

#08-83 Mc Corry Brothers, Union, Mgr., Paul Anastasio, paid the penalty of $7,500.00 for violation of N.J.S.A. 45:1-7 ©. This was for the Board’s information only.

#08-84 Berschler and Shenberg Funeral Chapels, Inc., Medford, Mgr., Howard Shenberg, paid the penalty of $100.00 for violation of N.J.A.C 13:36-5.6 (a) 9. This was for the Board’s information only.

# 09-02 Greenidge Funeral Home Inc., Atlantic City, Mgr.,Carolyn Greenidge, paid the penalty of $250.00 for violation of N.J.S.A. 26:6-31. This was for the Board’s information only.

ITEMS FOR DISCUSSION

Maryann Sheehan to arrive at 10:30 a.m to discuss Wilson Beebe’s request to amend the following Administrative Code (s): N.J.A.C.13:36-8.10, N.J.A.C.13:36-1.9 and 13:36-9.1, N.J.A.C. 13:36-4.5 and 4.4 and N.J.A.C. 13:36-10.3. On motion made by Mr. Lombardi, seconded by Mr. Wimberg, the Board determined to refer this matter to the regulation committee. All voted in favor of the motion.

PUBLIC COMMENTS

None.

EXECUTIVE SESSION - 10:00 A.M. On motion made by Mr. Wimberg, seconded Mr. Lombardi, the Board determined to go into executive session to discuss consumer complaints and/or conduct investigative inquiries. The results of these deliberations will be made known when and if the Board determines to initiate disciplinary or other law enforcement action. If the Board determines to issue uniform penalty letters, that action will be taken in public session immediately after the executive session.
