APPROVAL OF MINUTES

New Jersey State Board of Mortuary Science Open Minutes for April 7, 2009.

On motion made by Mr. Lombardi, seconded by Mr. Radzieta, the board voted to accept the minutes as read. All voted in favor of the motion.

EXECUTIVE DIRECTOR'S REPORT

Mr. Mandeville reported that the total number of complaints received in April are 3 and the total for 2009 are 17.

Mr. Mandeville reported that the next regular Board meeting has been scheduled for Tuesday, June 2, 2009 in the Hudson Conference Room, 6th floor.

Mr. Mandeville reported the Jurisprudence Examination has been scheduled for Friday, June 19, 2009 at Mercer County Community College.

The committee reported that section D) International Cemetery and Funeral Association numbers 1 - 6, the Board determined to hold. Section E) Thanos Institute, numbers 1 - 10 that was held from last months meeting each course was approved for four (4) hours only. On motion made by Mr. Radzieta seconded by Mr. McCriskin, the Board determined to accept the committee report as read. All voted in favor of the motion.

CORRESPONDENCE

Executive Director of the New Jersey Cemetery Board, Dianne Tamaroglio informs the Board that the Wednesday, April 8, 2009 meeting has been adjourned. The next scheduled Board meeting will convene on May 14, 2009. This was for the Board’s information only.

Howard Mackey, obituary notice appeared in the April 8, 2009 edition of the Star Ledger. This was for the Board’s information only.

Carolyn D. Johnson, Vice President of Everest The First Nationwide Funeral Planning and Concierge Service, advises the Board of the recent action taking by the Federal Trade Commission.

Andrew Giallella, expressed his gratitude towards the Board and staff for their assistance in helping him obtain his practitioner’s license. This was for the Board’s information only.

On motion made by Mr. Radzieta, seconded by Mr. McCriskin, the Board determined to go into executive session to discuss the certification of costs. All voted in favor of the motion.

On motion made by Mr. Brown, seconded by Mr. Radzieta, the Board determined to go back into open session. All voted in favor of the motion.

OPEN DISCIPLINARY MATTERS

Application for costs and attorney fees in the matter of Berardinelli Forest Hill Memorial, Funeraria Santa Cruz and Cremation at a Low Cost and Stephen K. Finley Certification of Costs. DAG Krugman to discuss with the Board. On motion made by Mr. McCriskin, seconded by Mr. Lombardi, the Board determined to reduce overall hours by 10 hours, there were more hours expended than were appropriate, there were some duplication and some items were not explained. The Board determined to reduce the attorney’s fees by 1.1 hours, costs by 10 hrs and transcripts fee accepted in full. All voted in favor of the motion. Ms. Churchman and Mr. Radzieta opposed.

The Final Decision and Order that was filed with the Board on April 14, 2009 regarding the suspension of registration for Berardinelli Forest Hill Memorial, Funeraria Santa Cruz and Cremation at a Low Cost and the unlicensed practice of Stephen K. Finley. This was for the Board’s information only.

EXECUTIVE SESSION - 10:30 A.M. On motion made by Mr. Lombardi, seconded by Mr. Radzieta, the Board determined to go into executive session to discuss consumer complaints and/or conduct investigative inquiries. The results of these deliberations will be made known when and if the Board determines to initiate disciplinary or other law enforcement action. If the Board determines to issue uniform penalty letters, that action will be taken in public session immediately after the executive session.
