APPROVAL OF MINUTES

New Jersey State Board of Mortuary Science Open Minutes for May 6, 2008.

On motion made by Mr. Lombardi, seconded by Mr. Galante, the Board voted to approve the minutes as read. All voted in favor of the motion.

EXECUTIVE DIRECTOR'S REPORT

Mr. Mandeville reported that the total number of complaints received in May were 8 and the total for the year are 38.

Mr. Mandeville reported that the next regular Board meeting has been scheduled for Tuesday, July 1, 2008 in the Hudson Conference Room, 6th floor.

Mr. Mandeville reported that eight (8) candidates are registered to sit for the June 20, 2008 Jurisprudence Examination.

Mr. Mandeville reported that the letters to the 53 licensee’s delinquent in paying the death certificate fees were mailed out and the Board’s office received a few back and some of them are paid.

Mr. Mandeville reported that election of officers will be in the agenda for next month.

The committee reported that section A)Matthew International, the Board is requesting additional information, section C) MKJ Marketing, was not approved, section D) ICCFA, number 6, was not approved, section E) National Funeral Directors Association, number 2, was approved for one (1) hour only and numbers 1, 3 and 4 were not approved, section F) MKJ Marketing was approved for four (4) hours only. On motion made by Mr. Goldstein, seconded by Ms. Churchman, the board determined to accept the committee report as read. All voted in favor of the motion.

OPEN DISCIPLINARY MATTERS

#07-105 Bagwell Funeral Home, Penns Grove, Mgr., C. Stephen Bagwell, paid the penalty of $1500.00 for violation of N.J.A.C.13:36-11.16 (b) and ( c), N.J.A.C.13:36-11.3 and 11.6 on May 2, 2008. Mr. Bagwell also provided his 2006 and 2007 continuing education credits as proof of compliance. This was for the Board ‘s information only.

#07-137 Harris Romano Funeral Home, Audubon Park, Mgr., Francis Romano, paid the reduced penalty of $100.00 for violation of N.J.A.C.13:36-5.14 and 11.19 on May 20, 2008. This was for the Board ‘s information only.

#08-05 Inglesby-Givnish Funeral Home, Maple Shade, Mgr., John Mc Glone, paid the penalty of $1500.00 for violation of N.J.A.C.13:36-1.9 (e) and three counts of N.J.A.C.13:36-11.2 (d)(2) on April 28, 2008. This was for the Board ‘s information only.

#08-24 Marrocco Memorial Chapel, Clifton, Mgr., James J. Marrocco, paid the penalty of $250.00 for violation of N.J.A.C.13:36-5.21 (a) and (b) on May 7, 2008. This was for the Board ‘s information only.

#08-27 Frank A Patti- Kenneth Mikatarian Funeral Directors, Fort Lee, Mgr., Frank Patti, paid the penalty of $500.00 for violation of N.J.A.C.13:36-5.12 (g)1 on May 1, 2008. Mr. Patti also provided a copy of the funeral home’s revised web site page as proof of compliance. This was for the Board ‘s information only.

#08-29 Caggiano Memorial Home for Funerals, Montclair, Mgr., Michael Caggiano, paid the penalty of $100.00 for violation of N.J.S.A45:1-7( c) on April 28, 2008. This was for the Board‘s information only.

#08-30 Hanna Funeral Home, LLC, Haddon Heights, Mgr., Stanley R. Hanna, paid the penalty of $100.00 for violation of N.J.S.A45:1-7( c) on May 8, 2008. This was for the Board ‘s information only.

#08-31 Louis Suburban Chapels, Inc., Fair Lawn, Mgr., Richard Louis, paid the penalty of $100.00 for violation of N.J.S.A.45:1-7( c) on May 2, 2008. This was for the Board ‘s information only.

#08-32 Rezem Funeral Home, East Brunswick, Mgr., Gretchen Prybeck, paid the reduced penalty of $100.00 for violation of N.J.S.A.45:1-7( c) on April 28, 2008. This was for the Board ‘s information only.

LEGISLATURE MATTERS

Assembly Bill No. 1815 - On motion made by Mr. Goldstein, seconded by Mr. Galante, the Board vote to support the bill. All voted in favor of the motion.

Assembly Bill No. 2735 - On motion made by Mr. Goldstein, seconded by Mr. Brown, the Board voted to support the bill. All voted in favor of the motion.

Assembly Bill No. 1805 - On motion made by Mr. Goldstein, seconded by Mr. Brown, the Board voted to support the bill. All voted in favor of the motion.

EXECUTIVE SESSION - 10:00 A.M. On motion made by Mr. Galante, seconded by Mr. Lombardi, the Board determined to go into executive session to discuss consumer complaints and/or conduct investigative inquiries. The results of these deliberations will be made known when and if the Board determines to initiate disciplinary or other law enforcement action. If the Board determines to issue uniform penalty letters, that action will be taken in public session immediately after the executive session.
