APPROVAL OF MINUTES

New Jersey State Board of Mortuary Science Open Minutes for July 1, 2008.

On motion made by Mr. Goldstein, seconded by Mr. Lombardi, the Board voted to approve the minutes as read. All voted in favor of the motion.

EXECUTIVE DIRECTOR'S REPORT

Mr. Mandeville reported that the total number of complaints received in July were 6 and the total for the year are 59.

Mr. Mandeville reported that the next regular Board meeting has been scheduled for Tuesday, August 26, 2008 in the Hudson Conference Room, 6th floor.

Mr. Mandeville reported that twenty-five (25) candidates passed and three (3) candidates failed the June 20, 2008 Jurisprudence Examination.

Mr. Mandeville reported no meeting will be held in September due to the Holiday and the New Jersey State Funeral Director’s Association Convention.

Inc., number 1 - 10 was not approved, it’s not online and there’s no information on the courses, section D) Practicum Strategies, number 1 was approved for two (2) hours only, section G) Funeral Review.Com, LLC, number 1 was approved for three (3) hours only, number 4 was not approved, numbers 7, 8 and 9 does not apply to the funeral industry, number 10 was approved for 1 ½ hours only, number 11 does not apply to the funeral industry, number 12 was approved for 2 hours only and number 12 was approved for 2 hours only. On motion made by Mr. Goldstein, seconded by Mr. Galante, the Board determined to accept the committee report as read. All vote in favor of the motion.

CORRESPONDENCE

Executive Director Dianne Tamaroglio, informs the Board that the Thursday, August 14, 2008 regularly scheduled Board meeting is adjourned until September 11, 2008. This was for the Board’s information only.

Mike Micodemus, Chairman, Cremation Association of North America, Crematory Operator Certification Program, provided the Board with a letter informing the Board of the benefits of the program that has been provided to operators for seventeen (17) years. This was for the Board’s information only.

OPEN DISCIPLINARY MATTERS

#08-48 Dennison Funeral Home, Vincentown, Mgr., Richard Dennison, paid the penalty of $100.00 for violation of N.J.S.A. 45:1-7© on July 18, 2008. This was for the Board’s information only.

#08-49 Dennison-McGee Funeral Home, Burlington, Mgr., Richard Dennison, paid the penalty of $100.00 for violation of N.J.S.A. 45:1-7© on June 19, 2008. This was for the Board’s information only.

#08-51 Frank Halpin’s Brookdale Funeral Home, Bloomfield, Mgr., Frank Halpin, paid the penalty of $2,500.00 for violation of N.J.S.A. 45:1-7© on July 18, 2008. This was for the Board’s information only.

#08-52 Jackson Funeral Home, Neptune, Mgr., James Robinson Jr., paid the penalty of $1,000.00 for violation of N.J.A.C.13:36-9.7 (a) 1 and 13:36-1.9 on July 10, 2008. Mr. Robinson also provided his revised forms as proof of compliance. This was for the Board’s information only.

ITEMS FOR DISCUSSION

Maryann Sheehan, to arrive at 10:45 to discuss the final draft of the proposed regulations N.J.A.C.13:36-1.8, N.J.A.C 13:36-4.9 and N.J.A.C 13:36-5.17 and 13:36-5.18. On motion made by Mr. Goldstein, seconded by Mr. Brown, the Board determined to accept the proposal and approve it for publication. All voted in favor of the motion.

PUBLIC COMMENT

Michael Mittenzwei, NJSFDA, wanted to know why the penalty for case #85-51 was higher then #08-48 and #08-49 for the same violation. DAG Krugman stated that it is not the first violation and Mr. Mandeville had to contact the funeral home on several occasions. Also he wanted to know about the Sunday and Holiday charges that appearing more often. The Board stated that the charges have to be removed.

EXECUTIVE SESSION - 10:05 A.M. On motion made by Mr. Goldstein, seconded by Mr. Galante, the Board determined to go into executive session to discuss consumer complaints and/or conduct investigative inquiries. The results of these deliberations will be made known when and if the Board determines to initiate disciplinary or other law enforcement action. If the Board determines to issue uniform penalty letters, that action will be taken in public session immediately after the executive session.
