PUBLIC SESSION MINUTES
APRIL 18, 2008

The April meeting of the Physician Assistant Advisory Committee was convened in accordance with its notice to the Secretary of State, the Bergen Record, the Trenton Times, Star Ledger and Courier Post and was conducted in accordance with the provisions of the Open Public Meeting Act.

President Argast convened the meeting at 9:00 A.M.. The following attendance was recorded for these Minutes.

PRESENT: George Argast ABSENT: Claire O?Connell Todd Newman Dr. Jeffrey Berman Jeffrey Maas

Also in attendance: Dorcas K. O?Neal, Executive Director, Debra Levine, Deputy Attorney General and Kathleen Griffith, Staff.

I. APPROVAL OF MINUTES

a. The Committee deferred approval of the minutes of March 14, 2008, due to lack of a quorum of attendees at the March meeting.

II. OLD BUSINESS

a. The Committee reviewed a fax from Eric W. Gross, Wolf Block, LLP, inquiring as to whether a general business corporation owned by non-physicians, may lease a physician assistant to a licensed physician for use in his or her sole proprietorship. REAGENDIZED

It was the consensus of the Committee that more specific details be requested from the querist who provided hypothetical details. Mr. Gross will be so advised.

b. Revised Application - The Committee determined that the packet be placed on the June agenda. Mary Ann Sheehan, Regulatory Analyst will be asked to attend the June meeting to review the application package with the Committee. REAGENDIZED

III. NEW BUSINESS

a. The Committee reviewed the Revenue Review of Board of Medical Examiners, as informational.

b. The Committee reviewed a fax from Eileen M. Silvestro, Practice Administrator, inquiring as to whether a physician designee who is outside of the practice can oversee the practice and supervise the physician assistant while the supervising physician is out on maternity leave.

The Committee determined that a physician designee must accept and fulfill the responsibilities of the supervising physician and that a new supervision form must be submitted to the office. A copy of the regulations which govern the practice of physician assistants will be sent to Ms. Silvestro.

IV. REVIEW OF BOARD OF MEDICAL EXAMINERS MINUTES AND AGENDA

a. The Committee reviewed the Ratified Open Board Minutes for February 13, 2008, of the Board of Medical Examiners, as informational.

b. The Committee reviewed the Ratified Open Board Minutes Disciplinary- Matters for February 13, 2008, of the Board of Medical Examiners, as informational.

c. The Committee reviewed the Open Board Agenda for April 9, 2008, of the Board of Medical Examiners, as informational.

d. The Committee reviewed the April 9, 2008 Open Board Agenda Disciplinary-Matters of the Board of Medical Examiners, as informational.

V. REVENUE REPORT

a. The Committee reviewed the Revenue Report for March 2008, as informational.

VI. LEGISLATION/REGULATION

a. The Committee reviewed the Physician Assistants Pamphlet Laws, as informational.

b. Proposed Amendments : N.J.A.C. 13:35-2B.12 Requirements for Issuing Prescriptions for Medications; Special Requirements for Issuance of controlled dangerous substances. Awaiting adoption. DAG Levine advised the Committee that this regulation has been signed by the Board of Medical Examiners and is awaiting final signature of the Attorney General?s office.

There being no other business to come before the Committee in Public session, on a motion by Jeffrey Maas, seconded by Dr. Jeffrey Berman, the Public Session was adjourned and the Committee convened in Executive Session for the purpose of receiving counsel, to conduct one (1) investigative inquiry, to review seven (7) items of old business and to review eight (8) applications.

The Committee reconvened in Public Session. The next scheduled meeting is June 20, 2008. There being no other business to come before the Committee in Public Session, the meeting was adjourned at 12:30 P.M.
