STATE BOARD OF PROFESSIONAL ENGINEERS CALL TO ORDER The meeting of the State Board of Professional Engineers and Land Surveyors was called to order by Vice-President James K. Valenti at 9:00 a.m. at 124 Halsey Street, 3rd Floor Union Conference Room, Newark, New Jersey. All parties were duly notified of the time, date and place, with all pertinent material being provided. SUNSHINE LAW ANNOUNCEMENT Vice-President Valenti read the statement required by Chapter 231, Laws of 1975 known as the Open Public Meetings Act, and announced that notice of this meeting was prepared in the office of the Board and mailed to the Secretary of State, the Newark Star Ledger, Trenton Times, the Camden Courier Post, Bergen Record, and the Atlantic City Press.

REVIEW OF MINUTES December 20, 2007 The Board reviewed the December 20, 2007 minutes and on a motion by BM Purcell, second by BM Frantz, voted to accept the minutes as submitted. BMs Marshall and Vernick abstained. February 7, 2008 The Board reviewed the February 7, 2008 minutes and on a motion by BM Purcell, second by BM Frantz, voted to accept the minutes as submitted. BMs Jones and Vernick abstained. February 21, 2008 On a motion by BM Schwartz, second by BM Marshall, the Board voted to accept the minutes of February 21, 2008 as submitted. BM Purcell abstained. COMMITTEE REPORTS Legislation/Regulations Ms. Schirpio appeared before the Board to discuss Bill A1824, formerly A3753, which revises the licensing requirements for licensure for land surveyors. The Board will review its prior comments to determine if any changes are necessary and will table this matter to its next meeting. On a motion by BM Vernick, second by BM Schwartz, the Board voted to oppose Bill A2146, which abolished the Certified Landscape Architect Committee. The Board maintains its prior position as to amendments to the pending legislation, but also took the position that the functions should be transferred to this Board. On a motion by BM Purcell, second by BM Vernick the Board voted to adopt the proposed Home Inspection Advisory Committee regulation regarding duplicate fees. Joint Committee VP Valenti reported that the Joint Committee determined that both registered architects and licensed professional engineers can design retaining walls and perform calculations, regardless of the height of the retaining wall. Licensure Promotion The Board is waiting for confirmation from Rutger’s University for a date to meet during April 2008. On a motion by BM Schwartz, second by BM Frantz, the Board voted to offer all examination testing disciplines available from the National Council of Examinations and Engineering Services (NCEES) commencing with the October 2008 examinations, since no additional expense or overhead would be incurred. BM Koo opposed. Surveying - Administrative Code Update Peter Lazio Constraining Network Adjustments to OPUS-RS Coordinate Observations 6 REPORT OF THE EXECUTIVE DIRECTOR General Report ED Russo reported the administrative delays which are occurring as a result of the hiring freeze and the recent loss of several staff members. ED Russo announced as a reminder that the National Council of Examinations for Engineering and Surveying (NCEES) is holding their 87th Annual Meeting on August 13-16, 2008 in Minneapolis, MN. BM Frantz informed the Board that nominations will be taken at the April 3, 2008 Board meeting for President and Vice-President. BM Purcell reported that the Department of Environmental Protection is rejecting documents which exclude full license numbers. This matter was tabled. VP Valenti discussed the Board’s prior request to send a letter to all the examination candidates whose grades were not released pending investigation into examination irregularities and asked that the Board Office follow-up to make sure that the applicants were notified of the grades by the Board Office and, further, were licensed, if they passed, or advised that they could sit for the next examination, if they failed. Incoming Correspondence
James H. Waltz (Response to Board’s request) Mr. Waltz has requested a clarification regarding boundary markers that are not actual corners of the survey, and those markers that are corner markers. This matter was tabled until the next meeting. Outgoing Correspondence
Laura Kepner Ms. Kepner requested clarification of an article published by the American Society of Civil Engineers (ASCE) regarding a case study on ethics. This correspondence was noted for the record. REINSTATEMENT APPLICATIONS: Andrew J. Desiderio, Jr. The Board, on a motion by BM Purcell, second by BM Vernick, voted to approve Mr. Desiderio’s application for reinstatement. Xavier F. Gonzalez The Board, on a motion by BM Schwartz, second by BM Purcell, voted to approve Mr. Gonzalez’s application for reinstatement. He also stated that all topography should be done only by a professional land surveyor. Charles "Chip" Adamson, PLS, the new President of the New Jersey Society of Professional Land Surveyors, spoke about a plan to build coalitions among the various professional societies. MOVE TO EXECUTIVE SESSION The Board, on a motion by BM Schwartz, second by BM Vernick, unanimously voted to enter into Executive Session to review disciplinary matters. RETURN TO PUBLIC On a motion contained within the Executive Session minutes, the Board re-entered into Public Session to adjourn. ADJOURNMENT On motion by BM Frantz, second by BM Vernick, the Board unanimously voted to adjourn the meeting at 2:00pm. APPROVED BY:
