Division of Consumer Affairs Cites Motor Vehicle Dealerships
For Violating Laws Governing Used Car Sales
NEWARK - The State Division of Consumer Affairs has issued notices of violation
related to the sale of used vehicles to 49 motor vehicle dealerships throughout
the state as a result of unannounced inspections conducted earlier this year.
The dealerships cited either failed to post prices for the used vehicles offered
for sale, in accordance with the Consumer Fraud Act, and/or failed to post a
Used Car Buyers Guide in used motor vehicles, in accordance with the Used Motor
Vehicle Trade Regulation Rule and the Motor Vehicle Advertising Regulations.
Consumer Affairs investigators found 49 of the 97 dealerships inspected in Burlington,
Camden, Essex, Mercer, Monmouth and Union counties to be in violation. Of the
2,144 used vehicles inspected, 1,492 were offered for sale without a posted price
and 472 failed to contain a Used Car Buyers Guide.
“The purchase of a motor vehicle is a major expenditure for most consumers,” said Attorney General Anne Milgram. “We expect auto dealers to comply with all applicable consumer protection laws, regardless of whether the transaction involves a new or used vehicle.”

“Consumers should be fully informed of the price and any available warranty prior to their purchase of a used vehicle” Consumer Affairs Director David Szuchman said. “The law requires dealers to post prices and provide Used Car Buyer's Guide for every used vehicle offered for sale.”
By the notice of violation, Consumer Affairs seeks to ensure that the dealerships post the selling price of, as well as Used Car Buyer's Guides, in all used vehicles offered for sale, along with a civil penalty and reimbursement of investigative costs. The dealerships have fifteen (15) days to respond to the notice of violation.
